John H.:

Suggest you read the recent interview of Commissioner Welsh. Civil penalties are a primary line of punitive action used by LOC in order to force compliance by the operator.

This could eventually affect you, the mineral owner, if LOC determines that it should shut in certain wells (or even all wells) operated by the trouble operator.

An enforced shut-in of a well does constitute an obstacle as contemplated under the Mineral Code and can therefore hold your lease for the duration of an enforcement action.
