I have small acreage in the Sonnera well Lone Wolf #1 identified  with Wellbore API #347-32286. The original total acreage in the lease is listed as 693.2 acres and my land is NOT included in that. Later I assume somehow the acreage must have been boosted by adding in more owners or whatever to bump the acreage over 1000. I can't find any records in the RRC online data that lists the actual owners etc of the land in the lease. I have been getting royalty payments etc. Some time back (more than a year ago) I was told by Sonerra office I would have to go to the court house for the records. Why is this not in the online RRC records. Anyone know? And now to another question which concerns the activity of EOG and their drilling on land leased to Sonerra. Just down the road from me EOG has been drilling for some time now (I can hear the drilling at night from my bed). Sonerra has a producing well (Thunderbolt #1, Wellbore API # 347-32361) on acreage listed at RRC as 713. The new EOG well is permitted as Wellbore API #347-33194 on acreage listed as 195.82 and this seems to be "chopped" out of the bigger Thunderbolt acreage. Does this mean that some of the participants in the original lease to Sonnera are excluded from the new well?

The plats filed with the Railroad Commission Permits do not necessarily tell the whole story as to the size or configuration of a unit, as a basis for calculating unit factors (dilution factor).  The 'real' unit used for calculating royalty percentage (dilution) is the 'courthouse unit' which is filed in the county where the land is located (usually styled as a "Unit Declaration".  That is probably the reason that Sonnera told you that you would have to go to the courthouse for the records.  In some cases the plats filed with the RRC match what is filed in the courthouse, but if there is a descrepancy between the two, the courthouse unit is the operative one as a basis for calculating royalty interests.

If you go looking in the courthouse be sure to check for amended Unit Designations.  I know of some Valence units that have had multiple amendments filed.

 

347-33194 is the Standaland Trust #1H.  EOG has the deep rights on Sonerra acreage, for Haynesville/Bossier development.

For the Lone Wolf, the second survey filed with the RRC is the operative one used to calculate royalty interest but good to know that's not always the case. 

Often a trip to the county courthouse to look up documents is needed.  For those of us who don’t live in the area, there is another option.  Go to the County Clerk website for the county you need.  There usually is a link for land records online that will take you to a third party provider.  The fees vary with a minimum of $1 per page – the same rate I paid at the courthouse a few years ago.  Even when the cost is higher, it’s cheaper and more convenient than a trip.

Toward the bottom of the page, in red, you will see “Click here for Texas Land Records”.  On that screen, just underneath the tool bar, you will see a “click here” link to a free search for a specific county.  Select Nacogdoches Grantor/Grantee &Vital Statistics.  On the next screen select free search in the tool bar.

When you find the document you need, you pay to access/copy at a rate of $1 per page for the total number of pages in the document, whether you need only one page or all the pages in the document.  The search results index will show you how many pages are in the document.

I think it would be helpful to do a search online, even if you actually go to the courthouse because it will list amendments filed to the unit designation, or whatever document you are looking for, along with the date it was filed and the book, volume, and page number.  That can be found in the index without having to pay anything.  Take care to click on any item that is highlighted as a link to find all the documents available.

Sonerra assigned the deep rights to EOG. Units targeting different formations can overlap.  So , you may end up with royalties from multiple operators producing from different depths.  But, you could get included in one and cut out of another, only if your land is not in that other unit.

I like that Ben...think positive. I think EOG is looking at an 18ac site north of you so perhaps if they drill there and go south..ta da!  :)
I noticed today that it had been really quite around here and then it dawned on me I was not hearing the rig activity from the south. After lunch I drove the short distance down the road and found out why--the rig was moved out. As I was passing the site an empty hauling rig approached from the south and turned in to the site so there is still some stuff to be moved. I will keep a look out to see when the fracturing activity begins.
After the ice/snow of last few days I took the 1/2 mile drive down to the drilling site to  see if I could see anything new going on. The pad is close to the road but view is restricted by trees and I did not want to drive in since this is on private property. I did not see any signs of any major activities going on. I don't know if EOG is waiting for fracking operators or ?
Thanks for the update Ben. I suspect that EOG will do a similar well near the Lone Wolf like they've put Stanaland 1H next to Thunderbolt. If that happens I know I will have fun trying to calculate the royalty percentage on that one. :)
