I think that somewhere in the lease materials I've compiled there is a "continuous operations" clause that deals with Mike's concern. I need to go back and find that.
In looking through all the lease materials, I've not seen a provision that goes as far as to terminate the lease where the E&P is trying to HBP a unit with a single well. All the Pugh clauses I've seen only prohibit acres outside a producing unit being HBP. The continuous operations clauses I've seen are actually for the benefit of the E&P -- it allows acres to be held not only by production, but by active drilling operations.
For example, the Pugh clause in Alex's lease form provides, in part:
In the event a portion or portions of the land herein leased is pooled or unitized with other land so as to form a pooled unit or units, operations on or production from such unit or units will maintain this lease in force only as to the land included in such unit or units.
I'll keep looking for a more restrictive provision.
MFSIL, I tried to add a picture, but apparently it did not work. If you find a picture of LBP, please add it to my site. That's what I think I am--a gatherer of sheep.
