Does anyone know the current price per  rod for a pipeline to cross a portion of your property in San Augustine county?  The line will cross from one unit to another across a small portion of our property.  We were told (by the company man) that he was auhorized to offer $225/rod.  Another person in the business has told us $250/rod was the current price in SA.  Neither well is on our property nor or we included in the units.  Is there additional money for loss of trees?  What, if any, processes/procedues are used to control erosion?  We're talking over 300 ft ROW 50 ft, 25 ft temp work space.  During construction they have the right to use an additional 100 ft x 150 ft.
They will cross a creek.  Do we need a lawyer? Any info is appreciated. Thanks

How big of pipe and what company builting pipeline. If permanent easement is 50' then this must be about 24" pipe. The market for 8" pipeline 30' easements range 150-225 per rod plus any timber damage. If 24" pipe in 50' easement the range 250-500 per rod with market closer to 400-425 rod. The smaller # rods crossing the higher you can get per rod. Their first offer is always lower than they will pay. Don't get arrogant with them just tell them you want simply the market rate. You should have oil & gas attorney red line the ROW agreemnet before you sign it 100% recommended. You sign your own ROW agreement not theirs. I have had two pipeline across property up in Nacgodoches and Rusk County in last year.
You will have to weigh the amount of money involved and if you can get more and decide if you want to hire a lawyer to do all the work for you. You for sure need a lawyer to look over your lease agreement....However an O & G attorney will charge a ton of money.....Got a friend?.......and put down everything you can think of in your easement agtreement....You might have to strike some things but always go for everything up front. .........especially for things that might happen in the future. I have a 42" MidContinent pipeline (50' permanent easement) through my place in Cass Co. and it is unbelieveable how they will try to take advantage of the land owner. Timber: Get a forester to estimate the value if you have enough to warrent hiring one. Then you can sell the timber yourself getting a little more cash. Pipeline company will just pile and burn.....you get it out of the way and it saves them money, even though they have paid you damages. Everything needs to be worded in very specific detail. Fencing.....type of post, distance for spacing, type of wire, etc....type of grass to be replanted, amount of ferterlizer, lime.....Or once they release everything except the perminent ROW, then have it replanted in trees......They should pay you for any extra work space....creeks will be governed by EPA........EPA is very picky about any disturbing creeks, wetlands, etc. You would not believe all the government people that will be on your place. I even had a team come through looking for native american artifacts......And NEVER EVER SIGN A RELEASE UNTIL ALL THINGS ARE DONE AND BACK IN PLACE...........They will try to get you to do so. AS the other reader replied DO NOT sign their agreement....It is for their benifit and they want to save as much money as possible.....By the way they will lie to you....Maybe tell you that you do not have to pay taxes on some of the money for ROW..........Wrong.....been there and experienced that....Check with your CPA....This is just a tad for you to consider..........rcd
Thanks so much for all the info, we haven't signed anything and they keep changing the number of rods. We are in the market for an attorney. I know several names have been posted on this sight, but I haven't been able to pull them up. I remember one was in Lufkin and the other in Nac. If anyone remembers could you please post. Thanks

What company? What size line?

When I say company you have to be pretty specific when you ask them "Who" they are working for. That means WHO do they have contracts with if it is a private company.

What size line? and How many... be very specific when talking to them.

I don't disagree with the above posts. But bear in mind that IF the company has another option, they may take it. They can, for instance, do a deal with your neighbor and parallel your property line on the other side of the fence. Your neighbor gets paid and you don't. I've seen it happen. Just sayin'.
