Can anyone tell me is there a standard form for an Affidavit of Heirship for a Receivership Attorney. What does this need to say. I know you have to have someone else fill it out that knows all about you and your family heirs. And have it notarized. But is there a standard form in the oil and gas field.

Check with the Clerk of Court where the affidavit would be filed to see if they can supply you with a form.  I am not aware of an affidavit of heirship form for the O&G industry as the affidavit deals with establishing family relationships and lines of succession and does not deal in any direct way with mineral interests.

Go to the courthouse, find an Affidavit of Heirship that is clear, reads well, is straitforward, contains all pertinent facts and copy it.  Take it home, retype it but substitute your information.

 

 

Thanks We will do that. We are still trying to get all info to help clear title. We have learned so much to realize we know nothing. Every little bit of info has helped us. We have found relatives we never knew existed. And I have really did a lot of research on this site. The info has helped and really taught us a lot of things to ask and keep in mine with the petroleum landman and the TRRC.

These affidavits are not difficult but there is some very pertinent information they should and should not contain:

 

Date of death and whether their was a will and/or probate on the estate and in which parish/county

Date of marriages and/or divorces and which county/parish

List of children (whether living or deceased)

USE FULL NAMES (First Middle Maiden Last)

Do not use social security numbers!

Do no use birthdates!

 

The more in depth the family tree information - the fewer title problems down the road.  Good luck with it!

 

We have been contacted by another landman. This one is petroleum landman. We are what we consider the generic heirs because the only reason we are in this is because our Grandmother outlived her husband. which would be our step Grandfather. One of the blood heirs contacted the Rec. Attorney and she was advised to provide a Affi. of heirship. There are only a handful of us on our Grandmothers side. We know we have the Min. Rights for life. But we were never told there were 3 pro wells, or anything. We were mislead from the beginning. So know the Petroleum Landman is trying to clear title. The last well has been moved this week  to Completed and Reporting pending approval selling gas. Whatever that means.The other 2 were have been producing for sev years. We have contacted TRRC to get data that we are waiting to check on. Have done a lot of reading on this site. Recieved lease copies. But we do not know who is in control of leasesing monies. XTO is in control of this one. Trying to clear title. We do not plan to sign anything. They say there is money in the Receivables but we all have to prove who we are.
