Find a new landman
No way...find a good O&G attorney.  What you sign is what you are locked in to forever.

Greg,

If you are willing to provide details as to your tract, you may find members of this site who have had similar (or different) experiences in leasing.  If you want specific information, you could provide us what I ask for below.  The more specific information you provide, the more specific will be the information you get back.

-  section, township, range (if you are in Louisiana) or survey (if you are in Texas)

-  how many acres you own

-  name of the company the landman works for, and what o&g company he represents

ok  thank you  guys ,

The company  is Anadarko , im guessing the company  the landman works for is HPSoil& gas properties. My land is in Evans , Vernon parish, 40.18 acres, section 11, all in township 1 south range 11 west.

I have had  received the lease bout two weeks ago , well the landman calls and talks to my sister who also has interest in the land..(there are 11 family members that  own a share )

... he seems to be trying to rush  the both of us to sign , stating that " everybody else has signed and that they are ready to drill ,waiting on me and my sister to sign. . he states that he wants the contracts  back or our portion of the mineral rights will go to the state..

First, undivided interest owners, which describes you and all your family having a percentage ownership interest in the mineral tract, can deal with their proportional share as they choose.  Some can lease, others can choose not to lease.   There is no legal requirement to lease and you are not "holding up" development.  Second, as an unleased mineral interest in a drilling and production unit you have protections under the LA. State Mineral Code.  Neither your mineral rights nor your royalties in a producing well are "going to the state".  Lastly, call Anadarko and report this "landman".  Follow it up with a formal letter of complaint.  Send it certified.  I think that if Anadarko knows how this "landman" is representing them, he will have a short employment on their land work.
thank you man!! youre comment is verry much appriciated  as are all of  the time that you all are taking to respond  to my situation.. he has stated that today would be the deadline ...,  how long after a contract is mailed , do i have to  respond .. the draft  that was sent says void after 180 days ..
If there is an extension option contained in your lease and the lessee has sent written notice and payment prior to the expiration date,  the lease is maintained regardless of whether you accept it or not.  If you were not noticed or paid in a timely fashion, you will need to get advice from an experienced O&G attorney.

and that my lease was up the day before he called,????? and he had filed an extention....

ok what makes no sence is that ,why would he call to remind me  or to converse and discuus  on the day after it is due ? when he  has taken time to personally meet and greet the rest of the interest owners ? I know i live a little bit away , but  what the hell ??? to me it all  sounds  like a sissy move.

Greg, if you wish to have accurate replies you must give clear information.  You originally stated that , "I have had  received the lease bout two weeks ago".  Now you state, "that my lease was up the day before he called".  The first sounds as if you did not have a lease.  The second sounds like you had a lease which expired before you received notice and payment for the exercise of an extension option.

the contract says it was printed  july 12.. i recieved it in the mail  stamped juy 26 ,27  the stamp is undeterminable on the last digit, but definatley  round 2 weeks ago,  as of today..

the landman calls us yesterday, first time ive heard from him since i received the contract.   we let him know that we are interested in  signing , under some more favorable conditions, and that i didnt want to go into a contract blind.. he gets  huffy.. stating that,.. my lease was up and he had filed an extention that extended it till today8-10-11.. is what im guessing he means.. and that  he needed to close this case ,everybody has signed exept me and my sister,  that if we did not sign that they would procedeand  the state would get the royalty..  so as far as if the lease was up, is up , i have no clue
