I had a phone call requesting correct mailing address and it kind of got my hopes up.  lol

there was a well permitted 11-22-11 by comstock serial  number 244138

What exactly does that mean?  Unfortunately, not very well versed in this area.....thank you

Comstock has been given a permit to drill a well and Les B post of Haynesville Shale Rig Count dated 1/13/12 shows a rig on site to drill 244138.  Good Luck.

Hi, You may have several options to consider depending on the amount of acres.

Trying to add you as a friend but not seeing the option.  I only have 16 acres.  Pls send friend request or go into a little more detail here if you don't mind.

Donna, are you leased or looking to be leased? If the later, this site can be very helpful.

I leased 12 out of 16 acres....the 4 I didn't lease, belonged to my deceased brothers children, but I have bought them out.  I would love to lease the other 4, but Comstock - who I am leased with for the 12, doesn't seem to be interested in leasing, any longer.

Actually, they seem to the think the entire 16 is leased, but as I explained to them - if they do the math - it is only leased for 12.  I'm sure there are things I do not understand, but I can do the math  lol.

"They" are probably correct, Donna.  O&G leases commonly include clauses that cover "after acquired" mineral rights that are in the same or adjoining tracts covered by the original lease in its primary term.  Read your lease carefully.  The language I mention is quite standard.

Here is an example:

Notwithstanding any particular description, it is nevertheless the intention of Lessor to include within this lease, and Lessor does hereby lease, not only the land so described but also any and all other land owned or claimed by Lessor in the herein named survey or surveys, or in adjoining surveys, and adjoining the herein described land up to the boundaries of the abutting landowners, the leased lands being hereinafter referred to as "said land." For the purpose of determining the amount of any bonus or other payment hereunder, said land shall be deemed to contain 223.5 acres, whether actually containing more or less. Lessor agrees to execute any supplemental instrument(s) requested by Lessee for a more complete or accurate description of said land or instrument(s) to perfect title deficiencies.

Thanks Skip, guess I should have taken the offer at the time - no one seems to be interested in leasing the "other" 4 acres now.  Although, at the time - my landsman stayed on me wanting to lease the 4, I just didn't want to do anything illegal.  I was having a hard enough battle trying to acquire the remaining 4.  My loss :(   but at least I now own all 16.

My point is that your existing lease likely covers the additional acreage through a provision such as my example.  I can assure you that an operator wants every acre under lease that it can get at acceptable terms unless they have decided not to develop your section. In your case there is a well drilling as we speak.  Call up Comstock and let them know you have acquired the additional 4 acres and would like it included under your existing lease.  Then send a certified letter with a copy of the conveyance document by which you acquired the rights to the additional 4 acres with a request for a check reflecting the additional bonus based on what you received in your original lease.
