We signed a lease June 2011 with XTO for Commodores 1H, as of this date we've received no correspondence from XTO. When we call XTO 1-866-886-2613 they tell us the checks will be mailed we're still waiting. There are two wells on the site, but one is in "Suspense" I wonder why? 

When we do get a payment from XTO how will we know if we're getting the royalities and interest we're owed since June 2011. Our lease expired in June 2012 it has yet to be renewed. What are our options, I'm thinking we need to hire an attorney?

If they drilled a well the lease will be held by production so the expiration date is void.  You will get your money, sometimes departments get swamped and things get delayed.  

if you know the well's API, or serial number, I could possibly answer your question as to why one is in suspense.

well the well isn't in "Suspense" as it is still producing.  I talked to our Division Orders lady and she is guessing you didn't ever send in your division order.  It's probably a paper work mix up.  

let me rephrase.  They could have shut in the well temporarily because the last production I can see is from August.  XTO drills a lot of wells and another lady I know, it took her over a year to get her money.  I would call again and make sure you have all of your paper work done correctly just in case.  Even if the well is shut in, you will still get paid on what the well has already produced so you do have money coming your way....sometime!

How does the distribution work in the 90 acre tract? Do we share royalities from all wells in tract?

I only see one well named Commodores in Shelby County.  Commodores DU NO. 1H PP and BH are the same well.  I assume you are looking at a plat showing the lateral of the well...BH stands for Bottom Hole Location and PP stands for penetration point.  I do believe you will share the royalities but I am not 100% certain.  You don't need to hire an attorney, just keep bugging them.

Just checked the Commodores well for you.  That thing made over 2 BCF so far!  Great well I just wish the gas prices where higher for you!

Aren't we supposed to be paid under the prices that were in effect when the well 1st started producing, not today's rate, at least for a production in 2011? 

What are BCFs? I'm a former utility company worker, and we measured everything in KWHs or Cubic Feet.

Jennie Bell---I understand when you say you have a lease with XTO but are you sure your minerals are in the unit of this well- Commodores 1H?. You can go on the TRCC web site and look up the well and data on drilling permit that will show you the P-12 list of property owner in the well--- understand this it not final plat of unit. Check with  jffree1 member on this site she has a tutor on the TRCC Web site. If you have already done all this then contact XTO Direct about why you have not received DO on the well. Go to XTO website there you will find Contact info via phone numbers or email address or regular mail to Royalty Department. If you have a leases and minerals in the unit they must answer all your question.
