instead of going thru the telephone book, with the numerous amount of attornies there, i thought i would rely on others in the group to share information they found out. can anyone reccommend an attorney to talk with that doesn't want some kind of contract to assist with information about mineral rights. i have spent 5 weeks waiting on an attorney, just to find out from my deed what my rights are. thay have not returned any of my calls, nor supplied me with any information at all. i will not contact them again, nor would i refer them to anyone, so, let me know if you would refer one. thank you for your help.

I have several questions and have no idea who to call. I sold 10 acres of land in rual Benton in 2001. There is no mention of mineral rights in the "Act of Cash Sale" that I am reading. Does that mean that I do or do not have the mineral rights? What kind of attorney do I need to contact or can I do some kind or research myself to find out? If I did own the mineral rights would someone have already contacted me? If I do own the mineral rights and have not been contacted what do I need to do? If there is anyone that can give me any answers I would greatly appreciate it. Thank you.
Jean,
I am not an attorney, but I just looked up your Deed to Mr. Burnopp. You did not reserve the minerals to that tract of land. If you are unsure about my opinion, contact Charles J. Neupert, Jr. who handled the transaction.
Sorry to be the bearer of bad news.
Thank you for the information. Would it make a difference if I had leased the land some years before selling it?
No.
I purchased property subject to an existing mineral lease. The seller didn't reserve minerals. I now receive royalties on that piece of property.

Once again, I am sorry to be the bearer of bad news.

It you have any questions, I would call Mr. Newpert's office since they are the Notary of record.
MINERALS AUTOMATICALLY TRANSFER UNLESS THEY ARE RESERVED.
jean, you have a lot of reading to do. do you have a deed? someone had to make it leagal. if you have a deed, and nothing is there about mineral rights, you probably do not. how long have you lived there? look at some of the attorney names that are in this discussion, and pick one of them, and just call and ask. that is the only way.
If you did not "reserve" your mineral rights in the wording anywhere on that "Act of Cash Sale" then the mineral rights transferred to the new owner IF you owned them at the time you sold the property. You might not have owned them when you sold the property because the person you purchased from might have "reserved" them when they sold it to you. Either way, it does not sound like you own them but remember this is free advise on a free website that is not legal advise to bank on. Just a starting point for you.
How about the man with the hat, Kirby Kelly?
try the lawyers that are advertised on this website!
That's a joke, right? If not, I have swamp land in Florida I'd like to sell you.
I heard he bought some hair, so he doesn't need the hat anymore!
You heard right.
