Has anyone heard anything about the suit a group in this area is filing because of low bonus payments?

I have not heard anything. Going just from memory, I thought that most of those sections were leased in the past 5 years or so and several shallow Glen Rose wells had been drilled. Do you know if the lawsuit was over new leasing that was done in the past 3 or 4 months or if it has something to do with the older leases taken out before the Glen Rose wells were drilled?
A lot of people in Sec. 21 signed right after Glen Rose was drilled. They got small bonuses and get NO royalties from the 2 producing wells. They feel they got a bad deal
So, getting a "bad deal" is a reason to file a lawsuit? Enact "Loser Pays" and watch these suits and the lawyers filing them go away.
I was told that in Europe there are not many frivalous lawsuites because if you sue and it fails they can sue you and get attorney fees back with damages, I was told in most US States one can only get attorney fees back in a coorporate lawsuite and not with personal/civil suites ? Jed
I do not look for much to come of these cases bases on lack of information , other than lawyer bills. They had the option to say "No".
I wish them luck though. Many of the smaller landowners in my area Jumped on the first BULK MAIL offer of a few free bucks.
The Lessors better get ready to pay the attorney's fees for the defendents. This is a no brainer in contract law.
I have heard of these lawsuits . I was told that they are based on people signing contracts not being of sound mind. Something like there kids have filed suit saying that a doctor has signed a statement saying that these people had alzheimers , dementia , etc when they signed the contract. And over the years I have known of these types of suites being successful with other matters and they should be. What if a 90 year old signed a contract and he/she had a mental illness. It should be nullified. Especially if it was a very low amount. Jed
My wife inherited land in S Caddo parish . Her father passed away about 3 years ago but he was in sound mind. He had started getting offers years ago for leases and they were very low. Her mother passed away a year ago and she had full blown worse case alzhiemers. Suffered with it badly for about 5 years. She would have signed anything for a nothing offer or would not sign for $100,000.00 acre and 75% royalties . She was very sick. I hope the law would back people like that and I believe that it does ? I hope . Jed
Diminished capacity filings are accepted.However most of the plaintiffs in these class action suits knew what they were signing at the time, and were happy til someone else got more. I abhor anyone who takes advantage of the elderly of incapable.
Im sure that a lot of these postings saying that the companies are now running out of money and landowners have been too greedy were posted by sound minded people who signed for nothing and just threw it away because they lacked good average business sense. This is there mental way of healing some of there hurts. I can just see some nut just jumping up and down shaking the house saying ha ha ha , You wanted more than I got now there running out of money or them just praying that this does happen. Of course the recent postings of offers and news reports plus just a minimum of common sense business accounting proceedures shows that this is not true. After I sign I hope people do get larger offers than me. It can only help the economy. Jed
One would like to believe that the contract was read before signing. I am speaking only of the class action in Caddo in which the landowners agreed to the offer, then as the bonuses increased, felt they "was Cheated". I am not referring to the cases when the subdivision developer, or government retained the rmineral rightds. We have all, I'm sure, bought things that went on sale the next day, or week. I offer only my opinion. Had I any direct knowledge of anyone being deliberated defrauded, I would probably be helping pay for their legel representation.
