We have never been approached for a lease on land that is now being unitized. My sister-in-law heard that leasing agents lie and claim you refused a lease so that they don't have to pay royalties. This doesn't sound legal. What's the law on this? We have leases for most of other properties but can't get Samson Contour to even return our phone calls on this. Pardon my french, but we don't want to get screwed. Any ideas?

If you own your minerals, you might make more money if you don't lease!

If you are unleased, you have options. You may enter into a lease (if they ever bother to contact you) or you may remain unleased. I suspect you understand what happens if you enter into a lease, so I won't go there. If you remain unleased, the law entitles you to collect your share of the production. What is your share? The law defines it as the total production attributed to your acreage, minus the cost of drilling and completing the well and the costs associated with operating it. The best place to start learning more is on the page of Caliente on this site. She has written a primer for the unleased mineral owner, and explains it quite well.
How do you collect your shares of the unleased . Are you in La or Texas. Do you know, if you are in Texas --when a well is drilled and starts pumping--when do you receive the first check. We had one that was pumping but then shut down. We got a check one year later. We oversees all this. I do not know how to go to Caliente. I just read that she is specific to Louisiana so that won't help me. Do you know anything about this in Texas.

I would ask anyone saying obvious lies to put it in writting and sign it. They need to be turned in to their the companies they work for. No company wants to represented by anyone like this.

There are several reasons many would not want to participate as a "partner" in a well. First all your eggs are in one basket. If the well has a mechanical failure and has to be redrilled or if the frac job gets messed up and you end up with a low producer, you will be carrying a balance for what could be a number of years. You also don't receive any bonus money. With companies paying 25% royalties for leasing, most view this as a better deal than gambling on big wells and not having to wait years before paying out.

I have ask under "report issues" for his/her name to be removed. The names Cheerleader and Caliente appear to be synonymous when in reality they are not.
