I have been calling CHK weekly since the week of 3/14/12. No payment. They have told me that the well has been in production since 2009. They acted surprised that we havent seen a check. Their call center , manned by very nice, college age sounding screaners, have let me leave messages for the well manager Deborah O'neal several times. No call back. She sent a message through one of them that she would review my file on 6/8/12. I have called back weekly since...no info or response from her. I am assuming that a demand letter is over due. I did not send one as previously recommended. Is there any recourse or is it worth it to hire an attorney at this point? Are there any O&G attorneys that don't work for them? I own 1.91 acres and it looks like they owe me around 6k.

I am incredibly surprised that CHK operates in this manner. Maybe I shouldn't be.

I own property in T15n R14w sec 19.  I responded to your previous post regarding non-payment.  I sent you a friend request to assist you further but you have not responded.  I do not believe you need an attorney, yet.

at 1.91 acres, you could try sending them a demand letter yourself.  You want to send it to your Lessee, so just confirm  you are leased and CHK is your lessee and not just the unit operator.   Include description, unit and well name, lease date, lessor name, etc...  State that your demand is in accordance with the mineral code.  And most importantly, send Certified/Return Receipt Requested.  They should respond within 30 days of receipt with an explanation or a Div. Order and check.

Doubt they will go for interest or fees since no previous demand was made in writing - unless you added a lease provision that says as much.

I have 18 emails in my inbox from Deborah O'Neal regarding issues on this same well and for contact information on others.  The dates range from October 2010 until February 2012.  I just want to say that she took care of my corrections of payment in due time given the mine field of departments involved to verify lease terms, revise the accounting, and authorize payment.  She even went to the trouble to defer a 12-3 disbursement into the next year which was great help in the tax dept.  Deborah gets my thumbs up.  You need to talk to her.  She is a very busy, but pleasant lady to work with.

Thanks Frank...good to know.  Can you share her email address with me.  That might be an easier way to communicate.  I am not doubting that she is nice, but they have to respond in some way form or fashion.

I'm one of the mineral owners on the Kelley well. It started out good but is down to a trickle now.

Join the club, sorry. I deal with their incompetence daily and nothing I mean nothing would suprise me. I believe that since their recent finacial problems and crooked managment, has them trying to cheat everyone they can get away with. Just think of the people who don't know any better or can,t calculate their interest. CHK will rob them forever.  You need to ask for statutory interest on all money owed to you. I believe that it must be in writiing and you should send everything certified mail, also keep all emails.

Everyone needs to know how to calculate what your decimal interest should be.   

take the number of acres you own 100% mineral rights of and divide that by the number of acres in the unit then multiply by your royalty percentage.    example    family guy owns 1.96 acres divided by 640 acres (1 section) times .25  (25% royalty). Ffamily guy has a 0.0007656 decimal interest in the well if he owns 100% minerals.

EVERYONE SHOULD CHECK THIS. YOUR DIVISION ORDER AND CHECKS SHOULD REFLECT THIS DECIMAL INTEREST SOMEWHERE ON IT.

You do not have to be incredibly suprised that chk operates in this manner.  This is standard operation for them. nothing new. Employes lie to you(they have to if they want a job) They, the ceo are crooks. that should explain it all. They spend millions on people that have influnce, but the small landowner is screwed.

Should I also be checking on mine? Have I been too patient? I just figured that when it started making money they would send me my little share. The well was completed in August 2008. I did not sign a lease so I understood it would take longer for me to ever see any money. They were offering such a tiny amount of signing bonus and I only have a half-acre..........so I would rather keep all of my royalites instead of the $75 they offered me ($150 per acre, one-fifth royalty). I was happy to keep my 100% on my little bit of property and get force pooled. My neighbors who did sign a lease have been getting checks for a couple of years...........about $100 4 times each year for their quarter-acre. I am in 19N 15W Section 9 in Caddo Parish. I too have not received a royalty check from CHK since February this year.  Phone calls have been made and not returned.  Well still producing.  People are paid to be polite on the phone, but the passive aggression is frustrating.
