I heard that there is a classaction lawsuit being filed against Brown Builders that will effect many neighborhoods around the area such as Southgate, Northgate and Golden Meadows to name a few...Does anyone have any info about the lawsuit? From what I understand they own all the mineral rights for approx 9 or 10 neighborhoods in the area..Has anyone else heard of this situation?

Sorry, I had personal experience with JMB, Northgate subdivision to be specific, yeeaaarrrss ago when I was young & inexperienced. I realized something was wrong when what they presented wasn't what one would get. We parted ways, but not before sales agent pitched a fit, and I haven't looked back since, or considered buying another one of their properties.
Just my experience, so in this instance I can't say these allegations surprise me.
I was under the understanding, In the state of Louisiana, if there is no "production" on the land for 10 years the mineral rights fall back to the owner of the land at the end of the 10 years. And "production" is coming from within the land.
the catch is, the new owner,or current owner, at end of ten yrs must file with state .it is a legal filing,do not know if there is a time limit.but is
incumbent on owner.
That's not true. There is no requirement that anyone file anything to prove that the mineral rights have reverted back to him.
i was told that by a local atty. i am not a atty, i do not know,
but nothing is easy wher these amounts of money are concerned.
I am not an attorney, that is why I said that you needed a mineral title opinion to know for sure or maybe for sure that you do indeed own your minerals (Previous post). The law firms will make lots of money in North Louisiana for a long time. Go Lawyers. Go Landmen. Go Shale Play cause we here in Louisiana have a lot of shale.
M. Mcwilliams is correct. Also minerals don't revert back if you don't own them in the first place as with dealings with the State of Louisiana or the USA.
Here is an example of what I will be filing 09/07/2008. Bought 09/08/1998 and last attempt at production was Pluged and Abandoned in 1993.
My land is under a current lease that expires 10/10/2008, but it also has and exclusive 2 yr extention for 100 an acre on it. So I want my name in the court house as now owning it. Mostly these are filed by the large land owners, but I think alot will be appearing now. I know I want my little bit coming to me.

When people buy a new house, I think it is a perfectly normal assumption that the mineral rights go with them...at least until the Haynesville Shale play hit.

If a builder/developer kept the mineral rights, the new owners should have been made aware, then they could choose whether or not to purchase the house.

Keep in mind that the beginning of the Haynesville Shale play goes back at least two years. Brown Constuction realized the opportunity to make more than just the sale of a house. Notice they transferred the rights from the company to the individuals. Sounds a little suspicious to me!
The majority of the mineral rights were sold to Brown family members for $100 a lot. This came directly from a Brown Builders representative during a meeting my father attended @ Bellaire Baptist. There was no mention of this in the sellers disclosure statement.

Most of my family in that area purchased their house prior to 2006 and are checking whether or not they own minerals.
Hi,
I searched the Conveyance Records of Bossier, the Mineral Deed in question was filed 07-06-2006. Prior to that I don't believe Brown usually reserved minerals. The Registry Number of the Mineral Deed is 870165.
