I would appreciate any good advice since I'm new to this and know very little.
My mom owns a house in a subdivision in Shreveport. Apparently Chesapeake is drilling there and all owners in the subdivision have an interest in 1/5 of an acre. My sister and I received papers from Chesapeake telling us we were naked owners and our mom has the usufrunct. It is a naked owner consent for a division order. Chesapeake says it is their policy to get naked owners to sign so the payment goes to the usufrunct. My mom said she was told it could only come to maybe $100 every other month since so many people have an iterest in a small piece.
Does this all sound right? They couldn't just send whatever to the three of us and we give to our mom? And does that amount of money sound right?
Forgive my ignorance. I'm just trying to find out. Can I call Chesapeake directly?

for such a small lot, yea the money is probally about right. you are looking at about a 0.0003125 % interest in the unit. thats a lot of zeros. Of course it all depends on the well... but at that interest and our abysmall nat gas prices, I wouldn't expect much.
As to the Usafruct, I would assume that the property was leased prior to her reciving the usfruct and you becoming a naked owner, otherwise I would have expected them to have you ratify the lease then. (or maybe not, it is CHK).
As a naked owner you own part of the property, but as per LA law the usafruct has the right to use and benifit finacially from the property until the usafruct expires (usualy at death). so if you refused to send the monies to your mother, conceivably she could sue to get those monies.
CHK is seeking to protect themselves from a fight over where they pay the roayities. Are you sure its a DO and not a ratification of the lease?
Don't be afraid to call CHK.
