I need some help with this one. We are leased with one co. & another is operator. Operator did Division Order Sept. 2011 & had a mistake in our acreage. I contacted operator's attorney & showed him his mistake. HE admitted his error. That co. corrected this to co. we are leased with who was undergoing a conversion in their computer system. Long story short, analysts from both companies assured us our payments would get to us eventually & they did last Dec. for all back pay. Spring forward Sept. 2013, no check. Contacted co. we are leased with who has now been bought by lg. co. I have had ONE email from them saying they are working on the glitch. Legal question: Based on past litigation precedents, I think we can demand to be released from our lease. Anyone dealt with this?

I agree Henry. I got a call back about 3 wks. ago when I told them I would be sitting in their lobby with a group of people in same section who are also not being paid until we got an answer. I got an immediate call back saying please don't do this--we are working on a resolution. I got that call for FIRST time in 3 months. The co. is in Houston, so I am thinking of getting a reporter from a major Texas paper to accompany me to their lobby to do a story on how big oil and gas companies treat people. I will probably do that after the first of the year.

Good for you. I have noticed a few people on this blog enjoy instilling fatalism in landowners and lessors. It is almost as if they revel in some form of divine right of the almighty oil and gas industry to ladle out stolen lucre to the rightful owners after the rightful owners run a gauntlet of spears and arrows. I am heartened if you can find a broadcast station to cover it. Maybe you can contact that royalty owners group NARO (National Association of Royalty Owners) here in Louisiana and they can help with the arrangement. Have you contacted NARO? If you have, I hope they were of service.   

The Louisiana Chapter of NARO was formed and is sponsored and run by Chesapeake, EnCana, QEP and a few other assorted industry members.   

So much for that. I hope a media outlet is found, with or without help.

I was addressing the sleazeball practice of stealing from royalty owners and landowners as was discussed by the poster. I think it is an excellent idea to have a section group invade the lobby of the corporate headquarters. The Dixie and Pine Island gas problems are not exactly featuring the real problem of royalty theft. If the Gannett rag would feature that, I would be impressed. 

I apologize.  I missed when you switched from fear of fracing to royalty deductions.

  I think you are on to something.  If they are not paying other owners in your unit, then it might be significant enough for an attorney to handle it if the owners were to join together.

  Or, at least, if a large group were to send certified demand letters.

  Sorry you are having these problems.  Your neighbors are lucky that you are working on it for them.

In the unit we are in, there are 5 owners with this co. All  stopped receiving royalties at the same time and ALL have been given different reasons from: Well isn't producing enough to pay $100 mo. (BS, I have the production numbers and they are same they have been all yr. & prices are higher) to the response that I got which is that I have a deficit. I asked how I could have a deficit and they didn't know.  I have learned something though, no matter how big the company NO ONE WANTS BAD PUBLICITY!!  I am going to send a demand letter after the first of the year along with the rest of the group.

Try being a surface owner only and dealing with the slime! I have stacks of letters from these dirtballs referring to my interest in "the property" I own it! You would me better off dealing with satan himself than this garbage

Recieved a certified letter from Encana on Monday about a check they are holding and they need to send it to me before they have to send it to the state as unclaimed property. Heard anything from any one because I cant think of anything but I will contact them on Thursday. S19-14-14 They are sending the monthly checks why not this one

James, we also have a small amt. of acreage in 19-14-14. It is weird that they are holding your ck. Yes, you need to contact them asap and make sure they have your address in their system. I think a lot of these companies have gone through a conversion system and have lost info. It happened to me one other time and when I contacted a co. they were nice, responded, and corrected. This could have happened to you. My experience with EnCana has been very positive.
