Though there are only two HA units in 9N - 13W presently, interested land/mineral owners should be aware that the development activity to the immediate north ( 10N - 13W) has increased significantly in the last few months. 10N - 13W now contains 28 HA Drilling & Production Units (out of ~36 sections). The southern most of those units are within a mile of the most northerly sections in 9N - 13W. Those members with unleased minerals in 9N - 13W, particularly the northern half, should be paying attention about now because it appears that their opportunity to lease is in the very near future. Hopefully they will make informed decisions.
My family and I which includes nieces, and nephews, were part of a group that Chesapeake left high and dry. They did not honor our Agreement to Lease. We had been sent leases to sign and these had all been executed. By way of explanation, our property had been partitioned in 1991 and we all had signed Agreements to Lease and Lease documents. Only 3 out of the 8 parcels were leased, 25 acres were left unleased. We are in Section 9; Township 9N, Range 12. As of this date, a drilling site is being developed in our section. So far, no one seems to very interested in leasing us. Would it be to our advantage to remain unleased, or should we be calling landmen? (I am Mrs. Grasshopper.)
grasshopper, CHK is obviously aware of your mineral interest in this unit. Post wide spread leasing competition, the most advantageous time to lease is after a HA well has spudded. I suggest that you hold tight and let the drilling begin. In the meantime decide on the lease clauses that you value and prepare your own Exhibit "A" page to present to the next landman that comes calling. Go slow and be deliberate. Once the lease terms are agreed to, then discuss lease bonus. The closer the well gets to completion, the more motivation for the operator to have you under lease.

So why are you not taking CHK to court? You were likely left high and dry at a much higher bonus than you will get today. There is no statute of limitations on this.
