I am one mad mineral owner! This landman has lied to all of us.

I got an attorney for all us ‘dumb poor folk’. I am in freakin graduate school but apparently I can’t read or understand or am capable of being taken advantage of. I’ll admit, she scored big on my uncle who just signed the first thing she presented… guess she thought we were gonna do the same.

The attorney emailed her and me stating the changes for 'Regan and relatives’. She proceeded to tell my family that the attorney was for me and that I didn’t like that side of the family. Excuse me lady??? I like them just fine, thanks!

Then I asked her to only contact our attorney and please stop calling. I was on a call with two of my cousins and guess what; she tried to call both of them.

We have a cousin that is MR (level of a young teenager) and she tried to tell her that they were the only company that does that and she had to sign today to get her money. This is AFTER we said that she will be signing her portion over to her sister (per her request!)
Then I said we will only sign together and she is still trying to arrange to meet us separately!

She is pressuring my family to sign, talking to us like we are dumb and don’t understand and lying to us!

I picked a hell of a week to quit smoking.

OH... i JUST found out that she showed up at my cousins house!!! She just showed up!

So... what's your point? Or, did you just need to vent at "greedy landowners"?
Silly greedy people. We should totally just sign the first thing they wave in our face even if the royalty is tiny. Silly me for being mad when the poor overworked landman pushed my mentally retarded cousin to sign a lease that EVERYONE said was bad. Do you think she understood what she was signing? The landman agreed to our attorney’s requests for the lease, but were they on my cousin’s lease? Absolutely not! Did we ALL talk to the landman about our cousin? Absolutly Yes.

Golly, maybe they should find the kids of mineral owners and get them to sign over their portions in daycare. Then when their parents pass it down, the energy companies will own them. You wouldn't have a problem with children signing the lease, would you? Mr. Ricky, they coaxed my cousin into signing and even offered to take her to the bank to cash it or help her open a bank account. Her little part she shared with her 4 sisters (about a grand) was gone in 24 hours. She doesn't have bills because the family pays for her rent and utilities. It was the equivalent of giving a 12 year old a grand.

You know, there are some greedy people out there, but you posted on MY thread thus insulting my decisions. Me personally, I don't want to be lied to or pushed or handled. I want a fair deal and don't care if it comes from a senior or a junior or Bill Gates. Is that an unreasonable request to you Ricky?
I would like the landman to send me the lease so I can read it instead of her telling me that I can read it when I sign it. Is THAT an unreasonable request?

I live my life knowing that I will catch more flies with honey then vinegar. I was nice to the landman through it all. Today I sent her an email apologizing for asking so many questions. I wrote her and said you must have a difficult job, but you get to bring good news to families. Silly me, I put on my big girl clothes and played nice while she tricked my retarded cousin.

So hats off to those hard workin landman who go out and tell families they just won the mineral lotto and even take them to the bank because they are 35 and have never driven a car or had a job because they were born a little less smarter!! Those dumb people don't need a fair amount, they didn't even know they had rights to it, right? Let's just pee on the little folk and help the energy company make some real money; they are the one doing all the hard work, right?

I'm not a lawyer, and suggest you talk this over with your own council to see what recourse you might have.

That said, if I were in your shoes, I would have my lawyer draft a certified letter to the landman you were dealing with demanding that your cousin's lease not be filed at the county courthouse.

If the facts are as you stated, it would be quite clear that your cousin would not be of sound mind and inable to legally execute the document on her own behalf.

You declare that you stated those facts upfront to the landman and yet we're told that said landman went ahead and took advantage of your cousin's state and knowingly presented the incorrect document to your cousin.

I would also let them know that you have no intention of returning the bonus money that was given (seemingly - if your facts are as presented) in a less than ethical manner to your cousin.

In return for the landman returning said "signed" document, you can let them know that you will refrain from bringing suit against them and their land services company for the manner that she acted with respect to your cousin.

Again, talk this over with your own council - but considering what you mentioned about your cousin, it does sound reasonable that it could be deemed that she is not mentally capable of entering into such an agreement without assistance from a guardian looking out for her own interest.

As usual jffree1 and D. Gaar are providing good advice. Since you already mentioned that you have an attorney involved, I would hope they would be providing some guidance in the same direction.
My attorney said we will just wait and see what happens on Monday. His normal rate is $400 an hour... I don't want to see a weekend rate! I can pick em huh?
Boo hoo. Poor oil & gas companies. What a bunch of hog wash. They are well compensated for the difficulties in their business. They (you?) all are doing everyone a big favor out of the goodness of their heart? I applaud the many hard working, honest folks in the industry. I don't applaud for the others. Does any upfront oil & gas industry person have to take offense at criticism about a bad apple? Is this the "oil & gas bidness, love it or leave it" defense?
Regan you need to call the company that this landperson works for and request or demand that a different landperson be sent to deal with you. I am not a attorney, just a Landman but I have to go in behind other landmen many times to try to unscrew the deal. One of my majors in college was with special needs individuals, so I understand where you are coming from with your cousin. From what I have gathered from your posts is that this landperson just screwed the company out of a grand.
Not to mention the possible lost "good will" of every land/mineral owner who comes in contact with any female landman working for EnCana in that part of San Augustine County. The grapevine is as fast as greased lightnin' around here.
I am going in behind another group right now in SW LA that thought that landmen needed to stay in the office and buy leases over the phone and by mail. One lady and her neighbor each had an acre in the prospect. Both were hard of hearing and she wore a hearing aid, she explained this to the landwoman and requested that she come visit with her and the neighbor to explain the details of the lease. This landperson didn't buy the lease because she was too lazy to visit with the folks or maybe she that one acre tracts were not worth the trouble. What this landperson doesn't understand is that this one acre is just as important to this lady as that 100 acres across the road is to that landowner. The only thing I had to do was put a no surface operations clause into their leases to make the deal.
Easy enough to do on an acre, I would imagine (the clause). Sounds more like sales people being paid on volume, doesn't it?
Well, maybe we just found out where all some of Enron's former boiler room sales reps ended up...
That was too long ago. It sounds like all the "sales" people who piled into land work in the middle of the frenzy two years ago. I guess some are still hanging on.
