The attorney that handled the transaction putting property into my parents name, that I later inherited, failed to file a deed. Chesapeake failed to see that there was a missing deed, so they paid an owner from the past. My parents did not get a title policy, but we found the unrecorded deed in the attorney's file, and have now recorded it. Chesapeake knows of the errror and says we will get the royalties. How do we get the lease money back to us?

It would appear that your land is unleased and you may own working interest in well or you may choose to lease to highest bidder. On the other hand it would appear that you may not legally own the land. Looks like you need GOOD ATTORNEY ASAP. The lease money maybe should be least of worries at this point.

Good Luck. These things do happen.
By the way, the US legal system has a severe flaw in that, even if you're the one who's been paying taxes on the land for many years, that has almost no bearing on whether you own the land or not. The government is perfectly willing to say, "Thanks for paying the taxes all these years, sucker. You're on your own in terms of claiming ownership of the land."
