That's quite a fee!  Had no idea.  I hope to remember that when negotiating pipeline R-0-W.  Thanks for sharing! You ought to share that on the South Caddo pipeline discussion page... regarding the Caddo Pipeline now being negotiated.

Crossing RR's is way different than crossing a regular landowner. On the other hand, the price paid to a RR company varies along with the nature of the pipeline company and how big their kahunies are. Another situation revolves around whether the RR company actually owns the R/W in fee or if it is only an easement for a RR. Most RR companies in the beginning, traded their fee ownership rights in what was considered waste lands,for timbered sections in the western states. It takes some real title detective work to determine that sometimes. Bottom line is that if a pipeline company has eminent domain, they can torte claim on a RR just like any other quase' utility company or county road crossing. If the pipeline company decides that a $1,000/year payment for a crossing is too much, they can go to court with their appraiser and fight. If the pipeline company does not have eminent domain, then they will have the same issues as they have trying to buy their way cross country. That includes paying whatever it takes to get across the RR.
