Four years ago my brother and I leased 28 mineral acres in Mississippi which was left to us when our father passed away.  We were each paid on 14 acres and signed separate leases.  The leases expired a year ago with no renewal. My brother passed away June 2009.  He had no family except myself and my mother and left no will.  Another company is now interested in leasing the 28 mineral acres again.  Do I now own the full 28 acres?  Should I file anything in the county courthouse where the minerals are located?  Thanks for your help.

You will need a death certificate and certified, notarized letters from people familiar with the family stating that there are no other children (any adoptions in or out of the family?)

I have not had to go through probate (small estates of mom & dad's) but I did need to certify by someone other than myself that there were no other potential heirs.
tell the landman... good chance he will take care of the paperwork for you.
