Have problem. My sister left a will which was probated through muniment of title. Her husband ,by terms of the will, has a life estate in her minerals. If I file an affidavit of heirship listing her 6 children by a previous marriage does that bring the children back into a share of the disbursment of royalties. Can I so to speak "top lease him " on behalf of the children.

The oil company involved seems prone to go the intestate succession route, giving the surviving spouse 1/3rd and the children 2/3rds
