Since I didn't get what I wanted on mineral lease it will cost them mucho to get to a section I get no royalties on. Unless they lease my property in Natchitoches Parish for more than I got in Sabine. Then the price to cross will be reasonable.

This is what I've been told regarding an old lease and whether or not you can claim the deep rights. Louisiana law says the driller must develop your minerals in a prudent manner. In other words, they just cannot hold your land forever, with no effort at producing the gas. The landowner must reap the benefit of the lease he signed. So far, so good.
Now... up until recently, the technology was not good enough for the gas company to "prudently" develop the deep stuff. Now it is. I see that 5-9-12 has not yet been unitized. What you need to do is find write a letter to the gas company who owns your deep rights, and demand that they now produce them, or release them to you. (If the lease has changed hands from company to company over the years, you may have to check all the sales, to see which company owns the deep rights after all these transactions. You'll likely need a pro or a lawyer to do this.)
The main point is to get the letter written, and on file with them now. They will have to respond within some amount of time (90 days?). If they come back and drill soon, well, they get to keep the deep rights. But, if they drag their feet and don't drill for a while, you may have a case to get your deep rights back.
As with all these things, "now" and "a while" are always subject to legal interpretation, so you'll need to get a lawyer, and not take my word for it.

Thanks for the information about possibly recovering my deep rights to the property. I recently contacted 3 different attorneys in the Shreveport area who specialize in oil/gas lease matters for help with this. No one responded. Do you know of any local attorneys (Sabine/DeSoto parishes) whom you would recommend?

Could this by chance be the reason 5-9-12 does not show to be unitized, because someone thinks it already is and has been for years? If so, shouldn't all of us in section 5 be notified of this? Also see my post on 4/7/09 to Tom Graves. If someone could help us on this question, it would be most appreciated.

Go to www.sabine index( which is a sabine parish newspaper) then look at clerk of court filings for April 2,2009, page down until you see OG & M Lease Grace Louise Copeland Litton to XTO Energy tract in section 5-9-12. I think that will answer your ??

I need some help finding the online Sabine Index, the Sabine Parish newspaper. The Sabine Index that I get is a travel agency. Also, I'm not sure if this will answer my question about section 5 being unitized already......hope it does but it sounds like the court filing is about a OG & M Lease that Grace received, who's land is in section 5-9-12. None the less, I would like to read the article and other posting of the Sabine Index that I use to enjoy when I lived in Sabine Parish.......would appreciate your help. Thanks.

Don't know who the land belongs to. I have a very small royalty interest in a producing oil well in that section, I inherited.... to read the news of sabine go to thesabineindex.com,go to the heading: more news, then to clerk of court filings for April 2,2009, also if you like reading sabine parish news,three other sites to read are sabinereport.com and for really local news go to sabineparishtoday.com and bdc.radio.com, hope you enjoy...

I finally figured out what I was doing wrong in trying to bring up The Sabine Index. I was entering "Sabine Index" instead of "The Sabine Index". Do you know if it is possible to find online the clerk of court filings since Dec. 2008, or for that matter since June 2008? June is when people in our pool accepted a bid from XTO but I have yet to receive payment. Thank you for your help.

Yes, it's possible, but they charge a $50.00 set-up fee/$100.00 per month. I guess it's primarily for attorney's use. If you are interested go to: sabine parish clerk of court, then to online access/download the form and send to them, I'm sure they will be happy to set-up for that amount of $$$. Good luck.

Is there any more news about Section 34? We haven't received a letter about being unitized...anyone else have any info. about this particular section? Thanks!
