honestly, this story doesnt seem that complicated to me. IMHO- the nephew would need only to "gift" the mineral rights and or leases or royalty, to the mother and aunt. the need for a lawyer would be to make it offical by filing it in the right places, and sending out the required notice to the intrested parties. who knows maybe he would get a big tax break for gifting. if it were me i would want to re-inherit the assett upon death of the recipient. thats just me...

The story (and what they want to accomplish) doesn't sound complicated KJ but the mineral estate might be. Just sayin'...

Hi Cindy Lou! My situation was a little different in that my 3 siblings GAVE me all the mineral rights which had been part of our parents' estate. I did most of the footwork and saved quite a lot of money. The attorney will need to give you the paperwork or send it but this is what I took to the attorney. (1) Names, telephone numbers and addresses of ALL those who would be involved in ANY way in the disposition of the estate. (2) Names and addresses of several people who could witness that the heirship was correct (people who had known our family and parents very well and for many years.) (3) I went to the Shelby courthouse, retraced and copied the properties involved back as far as possible, paying particular attention to any mention of mineral rights.

THEN, I took all of this to an attorney together with a letter from my siblings explaining what they wished to do....and about a year later, it was all done! (No need in its taking that long... my attorney got very ill)
I hope this helps. Unfortunately, a lawyer is an absolute necessity in this and recently, when Devon leased my property, they rechecked all, so keep copies of everything!

Thank you so much for the info. My sister is coming to Center today and we are going to start working on this "mess"
