Les, I just re read the pdf you attached and see that this well was permitted for 640 ac. Pulling a history shows that for yrs. there was no production & then it was reworked in late 1990s. How does that affect lease holders. Wouldn't that break in production have negated the initial lease?

 

Hay Kit, I haven't read this whole thread but with years of no production, that sounds like a dead lease.

If it's a dead lease, are all mineral owners in the unit entitled to 100% of their proportional share of production? SONRIS shows well is now producing a small quantity of gas and condensate. 

Go back and read the language of the lease with a fine tooth comb. Go onto Sonris and see when the well went down. Count the months.

I found old lease for Vernon Faulconer on town site well (Sec. 21) it was leased Oct. 15, 1997 and production started June 15, 1998.

 

Charles, I have Desoto Records online and some landowners in that section signed that lease, but not all did. here is my dilema:  we leased with Chesapeake in that section in early 2010. Have owned minerals since late 2009. We did not reserve shallow depths, only below the Haynesville. I can't believe I didn't notice that this was a producing well. I messed up. Do we get back pay from Chesapeake or go directly to Faulconer. There is NO record of previous owners of property we own signing any lease for that in 1997 or at any time
Noticing in Desoto Records online that Chesapeake has sold part of its interest in Sec. 21 well to Larchmont out of Oklahoma
when anyone receives a royalty ck for this section, will you please post that checks have started going out

I believe that Larchmont is Aubrey McLendon, CEO of Chesapeake. He had (until maybe recently) the right to purchase 2.5% of Chesapeaks wells.
You are right. I think Skip had a discussion on that earlier. When I looked at Desoto Records, I noticed that Larchmont has taken this right on a lot of good wells. I just had never heard of Larchmont until I was affected and just happed to see that they had bought a small percentage of this well. It went online in March, but so far can't find anyone who has received division orders
