Trying to figure out and gather opinions as to why a company would need access to a property after the expiration of the lease. The clause I speak of could give access for up to 10 year according to the attorney.

If it's 300 acres, it seems reasonable to work out ahead of time terms on items that matter to you, such as "no more than 10 acres of surface access, $x per acre bonus/$x per acre yearly rent, mark certain areas on a map as off-limits for certain activities, etc." Anything additional they want can be negotiated later.

You don't even have to be greedy, just don't give them carte blance.

You're nearly half the section. Drilling costs will be in the millions. It's reasonable for them to sit down with you and determine what they are going to do with your land.

Of course, nothing requires them to be reasonable, but nothing requires you to sign right now, either. Hopefully natgas prices will go up rather than down from here.
I have seen leases for over 600 acres with no-surface. Common for real-estate developments, golf courses, and airports.

Dosn't mean there wont be a well, just has to be negociated later. Could have a significant impact on Bonus or Royalty. Could also prevent you from being drilled.
I agree with Parker though, on three hundred acres I would want an attourney to help.

Is he rated AV in Oil and Gas?
There are a lot of lawyers with little experiance in oil and gas trying to cash in on the HA shale.

Did he miss the servitude or is the landman telling you that your lease says "....."?

They told me that my lease gave them the right to develop the property in the next section even though it didn't.
what is a standard distance from a residence that is typically negotiated?
The state already requires a 500' setback from all structures, unless the owner specifically gives a written waiver and this is attached to the permit.
