My name is Robert McIntyre. I am an attorney licensed in Texas. I also hold a BS in Geology. My principal practice over the last fifty years has been energy and corporate law. I am currently representing a working interest owner in Louisiana who owns a small, 1/32 working interest in numerous old, marginal wells. The wells are operated under a JOA and COPAS Accounting Procedure. In addition to other costs, the Accounting Procedure charges a fixed overhead fee to cover the Operator’s overhead costs. The initial fixed fee in 1972 was $150/well/month. The current fee is $1,665 due to the COPAS adjustment factor. The Overhead Fee is now the single largest cost in operating the wells. In fact for many wells the fee is greater than the wells’ revenue.
I am gathering information to asses the extent of this issue. I no not solicit and am not soliciting clients, rather I am looking for information. In researching the decades-old Tuscaloosa Trend and the immense wealth it has generated for many, I find it deeply troubling that this resource-rich formation runs directly beneath one of the poorest communities in North Baton Rouge—near Southern University, Louisiana—yet neither the university ( that I am aware of) nor local residents appear to have received any compensation for the minerals extracted from their land.
