Phillip: I have a similar lease where CHK holds 80% interest and PXP holds the remaining 20%. I did not receive a DO from Plains, but obtained a Plains contact from CHK. Plains was responsive and accommodating on getting the royalty checks started after I contacted them. If you can't get a contact, send me a private msg, and I'll provide the contact I used.
If you can prove to Chesapeake, that the acreage they state for your parcel is incorrect, AND can prove what the correct acreage is, you may be able to get them to consider revising your DO. However, you may need the patience of Job and mind-numbing persistence. For me, it took about 18 months of persistence (with lots of patience) to result in a revised DO. Still awaiting correction to the royalty payments, but expect it will occur in time. {I was never rude nor disrespectful, had I been, I seriously doubt any action would have ever occurred.}
When CHK "corrected" the DO, they increased the Unit Acres by the "corrected" amount. The original DO Unit Acres was already a few acres over that indicated in the PLAT. The only way I can think of to insure no hanky-panky is being done, would be if one were to have access to all DO's in the UNIT to insure the sum of all parcel acreage agrees with the stated Unit Acres. <-- I do not have access to this information, so am unable to resolve this discrepancy.
Good luck.

AboutAs exciting as this is, we know that we have a responsibility to do this thing correctly. After all, we want the farm to remain a place where the family can gather for another 80 years and beyond. This site was born out of these desires. Before we started this site, googling "shale' brought up little information. Certainly nothing that was useful as we negotiated a lease. Read More |
