Lisa,
If you are not leased, you are what we call the UMO (Unleased MIneral Owner). There are numerous discussions on this site about what you might do. You might choose to lease now -- you are free to do that. Or, you might choose to go unleased. Go to Caliente's page on this site, and read her write-up on what to do. Regardless of what you choose, your clock is ticking (I think). If you go unleased, there are some letters you need to start writing now, to the operator, letting them know you are unleased. Read what Caliente wrote, then if you have more questions, ask them, and someone on this site will be able to help.
Lisa, if you are willing to post your Section-Township-Range we can help provide additional information about your unit and well.
WAS YOU LEASE IN EFFECT WHEN THE DRILLING STARTED? BECAUSE IF IT WAS THEY DON'T HAVE TO RENEW YOUR LEASE. THE ONE YOU HAD WILL STILL BE ON RECORD AT THE COURT HOUSE. CHECK WITH THE RECORDS DEPARTMENT TO SEE IF YOUR LEASE WAS RELEASED FROM THE ENERGY COMPANY. SOMETIMES WHEN YOUR LEASE IS UP THE ENERGY COMPANY DOESN'T RELEASE THE PROPERTY RECORDED ON RECORD. START BY MAKING SURE YOUR LEASE WAS RELEASED AT THE COURT HOUSE FIRST.
