My discussion on minerals under the lignite mines in DeSoto and Red River parishes being imprescriptible reminds me to mention a few other instances where mineral rights have prescription suspended for a period of time or in perpetuity.
The servitudes under the mine plans are subject to prescription when they are released from the plan or the lignite mines cease to operate.
Servitudes under Toledo Bend Reservoir and under the right-of-way for Interstate 49 are permanent.
Prescription issues can be complex. It is advisable to engage the services of an experienced O&G attorney.
