I'm selling my producing royalty in Louisiana. However, over the last 3 years I was never paid by the oil company on some production. I would like to include in the sale language that would give the royalty purchaser the right to sue to recover the unpaid and underpaid royalty --- that was due me while I owned the royalty. The clause should also make the purchaser the sole owner of that unpaid royalty. I have been under the impression that in Louisiana, if you don't transfer the right to sue for unpaid royalty, the Purchaser can only sue for unpaid royalty on production --- starting on the day of Purchaser's ownership.
If anyone has such a Louisiana clause, I would very much appreciate it if you could share it. Thank you.

I think your question is appropriate for the Main Page as there is no better "group" in which to post. Keith is the only one that can move your discussion although you have the means to close it to further discussion and start the same discussion in another group.

I suspect that your lack of replies is that most members don't know how to answer your questions and those that do are hesitant to do so without detail. My answer is, see an experienced oil & gas attorney.
Thanks Skip for the guidance. It seems to me that I've seen this language in both Royalty Deeds and Cash Sales, but after searching high and low, couldn't find it. Thought the clause might be standardized enough to the end that a board member here might have it.
