My CHK lease on property in Dolet Hills, in DeSoto parish expired on May 1, 2011.  The lease was a paid-up 3 year term lease, no extension.  I used an excellent lawyer (I feel) out of Mansfield at this time and the lease contained all the various clauses that were being talked about in the examples used on the site in 2008.  I am being approached by Petrohawk now to lease this acreage (they seem to own most of the leases in this particular section so they want to see if they can get this lease to consolidate their holdings).  With folks experience over the years now and particularly with Petrohawk are their suggestions regarding:

  • Additional specific clauses, language that weren't perhaps deemed relevant in 2008, but now based on experience are important
  • Have folk had any success/experience including specific language regarding the benchmark to determine the price the owner gets (seems because CHK is selling to a subsidiary it is using something less than the benchmark)
  • Know signing bonuses are not in he 5 digit area any more, but would the 2K - 5K per acre be within what seems to be the norm
  • The lawyer I used in 2008 has retired and since I'm not local don't know if there currently lawyers in De Soto parish that folk have had recent experience that could be suggested to work with me on the re-leasing.

C.C., as to bullet points one and two, if you indeed have good lease language in the original, use it again with some review and possible revision to the "no cost royalty" clause.  Doesn't matter what company ultimately operates the wells, it needs to be iron clad as possible.  Yes, based on the size of your acreage and it's location in regard to the entire section, it should fit somewhere in that range.  A good O&G attorney is where you find them, DeSoto or elsewhere.  As long as they are familiar with the Haynesville/Bossier Play, office location is of second order importance.  If Coushatta is convenient, I would suggest the Beathard Firm.
