Section 8 Township 13N Range 12W - Chesapeake Stalling

This unit was drilled by Questar (two wells completed 10/15/10) and I am leased by Chesapeake who is stalling paying royalties to me.  Their latest reason (excuse) is that someone (not me) with whom they have a lease in this unit does not have clear title or ownership of their mineral rights and this makes it impossible for them to pay me until this situation is cleared.  I really do not believe this and even if it were true, I cannot see why this would affect my receiving royalties.  I am now in search mode for anyone owning mineral rights in 8-13N-12W DeSoto Parish, who is leased to Chesapeake, or if you know of anyone.   I only want to know if you are currently receiving royalty payments from Chesapeake for these wells.  I am going to go to the DeSoto Parish courthouse to search for this information but thought since there are so many wonderful people who read this board, possibly someone could help me.

You may want to consider hiring a mineral attorney. At the very least send a demand letter to CHk and carbon copy Questar. Send via Certified Mail.

Judy,

Read your lease.  Some leases specify that payments must begin within x days of the completion of the well.  Include that info in your demand letter, if your lease has such language.

Google "2009 Louisiana Code TITLE 31 Mineral code"

Read sections 137,138,139,140,and maybe 141. It tells you the LAW in Louisiana about timely payments of royalties and the very severe penalties that can be awarded by the courts if they are not paid in a timely manner. I had a similar problem in section 14 and after I wrote the letter mentioned in section 137 and referenced the penalties as described in the folowing sections for not paying in a timely manner, lo and behold the checks started coming.
