Frac Water Education Series: Legal Issues (Next conference call March 31st)

This is the 3rd part, of a 3 part series of conference calls dealing with Frac Water issues.

Who owns the surface water? It's a simple question with an increasingly complex answer. From the beginning of our series on water education, we've touched on legal and regulatory issues. Now we turn directly to these basic questions and others.   
 
In this session, we'll discuss critical legal issues of interest to water owners and water users with direct reference to controlling case law and statutes in Louisiana.   
 
For Energy industry insiders we'll cover: 

  •  What is a Cooperative Endeavor Agreement and why is it important?
  • Contracting issues to cover in buying water from landowners
  • Which public authorities should I be dealing with in order to buy state-owned water?
  • Who owns the water I want to buy?

For Landowners we'll cover: 

  • Do I own the water on my property or flowing along its border?
  • Are there legal restrictions on what I can do with it? If so, what are they and to whom do I have to answer?
  • Someone wants to buy my water - should I have a contract?
  • What issues should the contract address?
  • What is the (legal) difference between the water in my pond, the water in the bayou that runs through my property, and the ground water underneath the surface of my property?
