I've read about the importance of the Pugh Clause in a mineral lease. What if a person does not sign a lease and is force pooled as a UMI ? What happens to their shallow rights such as surface to 10000 feet and deep rights below 100 feet from the well vertical depth ? I can't find any info. on this, maybe I just haven't looked in the right places ! Any help would be greatly appreciated ...

From my standard lease:

b) on gas, including casinghead gas, or other gaseous substance produced from said land and sold or used off the premises or for the extraction of gasoline or other products therefrom, the market value at the well of one-eighth of the gas so sold or used, provided that on gas sold at the wells the royalty shall be one-eighth of the amount realized from such sale; such gas, casinghead gas, residue gas, or gas of any other nature or description whatsoever, as may be disposed of for no consideration to Lessee, either through unavoidable waste or leakage, or in order to recover oil or other liquid hydrocarbons, or returned to the ground, shall not be deemed to have been sold or used either on or off the premises within the meaning of this paragraph 4 hereof; (c ) on all other minerals mined and marketed, one-eighth, either in kind or value at the well or mine, at Lessee's election, except that on sulphur the royalty shall be one dollar ($1.00) per long ton.

My language above is from the standard LA Bath form. Most lesors woul be subject to it, or somthing very close.

I started researching a few days ago and would like to thank all those who have responded to my posts and cleared up a few lot of fuzzy areas. I now feel like I can make a half-way intelligent decision on whether "to lease or not to lease" and understand the lease language. I have no clue as to who the actual people are that responded but seems like a couple of them would make good state reps. to get between the big oil companies and the "little ole dumb country folk" like me and make sure their is no advantage for either side and to keep everyone honest. You got my vote !!
Or, maybe some of the info is just a misinformation tactic by the enemy to try and get the confused masses to make a decision that would more benefit the enemy. The previous statement is just a pathetic attempt at humor. I’m not really that paranoid (most of the time)! Have A Good Day….and thanks again for the education !

Pay attention to what you read here, but verify it.

If you're in the Haynesville Shale area with 12 acres, I'll say get a good O&G lawyer before you do anything. The dollars involved with make the initial consultation well worth the fee. Figure out what issues you need to discuss before you go to the lawyer to save time, money and understand the issues.
Not sure what I said that would give someone cause to question my qualifications to post to this site. Maybe I am taking it the wrong way. But in any case,,,, sorry if I said something or my attempt at humor offended, insulted or irritated anyone, that was not the intent. I’m just trying to find out as much as possible as quickly as possible. I chose to ask a few questions(that have probably been asked a hundred times before) rather than taking hours to read thru thousands of different posts trying to find the info I needed. Maybe that wasn’t the best way after all.
