Central and North Louisiana Land Owner Association (CANLLA)

I am thinking of starting a non profit organization. The organization would focus on land owner rights, lobbying for change in the Louisiana Mineral Code and Real Estate Laws to better protect Land Owner (and home owner ) interests, public education, and environmental watch re, the O&G industry in north and central LA. I would like serious input re, this idea please.

I promise as soon as I can catch a breath I will call you. I have been having meetings every evening along with my full time job, my 2 boys, research and getting the land owners who are going to be able to lease processed. I am running on caffiene and prayer right now! lol
Fill us in on the "class." Did they have anything to say regarding HS play?

I totally agree with you. My aunts live in Grand Cane Louisiana and signed a contract from BEUSA Energy to lease our 160 acre land. After the contract was signed my aunts realized that the O/G Company deceived them and now we have hired a lawyer to help our family receive a fair price for the land.

This could have all been avoided if information was available for my aunts before they signed with any one presenting a contract. I wish I lived in Grand Cane because I would have waited for other companies to offer various bids and then I would have been able to make a more informed choice.

I think this is a great idea and I would like to thank you in advance for thinking about the landowners. The main reason why I joined this group is to educate myself on various issues pertaining to lease agreements, contracts and the rights of the landowners. When you are new in this arena (I am new) the subject or rather questions to ask are scary and to find a group where I can ask questions without feeling/sounding dumb helps relieve my mind from unnecessary stress and open my mind to various considerations.

sounds good to me this whole h/s is a big mess i dont see why the fedral and local goverments witch are people that we elected just sit there and let the o/g companys screw hard working citizens with bs leases and laws that were made years ago. things change and the leases and laws should keep up without having to go through hell. all this mineral stuff would be non exsisting if things were simple like if you own land then you own all the way to china and when you sell land you sell it all the way to china and if the people in the section a well is at has not got a royality check of a certain amount during a year then that well should be deemed non productive and landowners lease should be terminated. just like the people in eagles nest getting screwed by the state with there minerals that is sick. good luck to you.
You bring up a good point. There are several issues I think need to be lobbied for change but one is definitely what can and cannot be HBP. Property in a non-unitized section should not be HBP after 10 years. Title searches should be required to go back to the first recording of the land, not just 20 or 30 years. Then there are the environmental loopholes, etc, etc, etc
OK, I will work on setting up a web site this weekend. KB, I know when I established my consulting firm I had to register with the state. Do I need to register a non-profit as well?
I think it is a wonderful idea. If we don't start asking questions-and demanding answers we can understand, nothing will change. The state is obviously not going
to do anything to help the landowners. If I can help you do anything, please let me know. Someday I hope to get Commissioner Welsh to answer my 3 questions regarding Redefining the HS. Why, Who benifited ( I know who - I just want him to
have to say it) and does he have any idea how many l/o he hurt by allowing this.

Kassi: you have contributed greatly to your neighborhood and viewers if this website. So in order to help you along I have attached documents that will be required for you to establish a non-profit. First is the Charter. The thoughts at the beginning of this thread is a good start. It will require 3 of you to incorporate w SOS, so you should include the Charter w application for Incorporation. Do not be too specific (gets you into trouble later by limiting what you can do w/o changing all this paperwork), but state the purpose and methods you will use to meet your non-profit 501(c)(4) goals. After receiving Incorporation doc from SOS, the Incorporators sign a Declaration appointing themselves as Directors. As Directors sign a Declaration appointing a President, a Treasurer, and a Secretary. The Treasurer s/b the one to submit paperwork to IRS. Paperwork to IRS will include Charter, Bylaws, Conflict of Interest’ and completed IRS form. Note that the Bylaws have a couple things of interest. First NO MEMBERS: members require that the bylaws describe how to become one, rules on how to keep membership, voting rules and on and on and on. This does NOT mean that a group cannot vote on any topic. It simply means that the Directors will make all Official final decisions (documented by Secretary). Second the Directors can meet in person, by phone, or by e-mail. This means you can have Directors anywhere (even out of state). This paperwork is designed for Charitable Non-Profits so it has language about how monies w/b handled. Tweak as necessary. IRS form should state No Paid Positions/Employees – if you ever need’em Directors can vote for it w/o changing paperwork. Directors need to understand that they will be the solicitors of any funds for you to operate (like website maint, postage, mailers). The website should be a .org site. Good Luck. I'll send you conflict of interest and the original declaration of Directors/Officers when I get to my desktop.
CANNLA - interesting acronym. CAN NWLA, Yes we CAN! I'm pretty well versed in the non-profit RS (not interpretation as I'm not in that line of work, but I've looked at them till I'm almost blind), and I've researched IRS info regarding non-profits, may even know someone who could help with that (and he is certified tax CPA). I agree with the person who says that when you but a piece of property that you own it lock, stock, and barrel, all the way to china. I do not understand why you can retain mineral rights to a property if you have no money invested in getting minerals out of the ground on your property. What in the world makes it right for someone to sell a property without selling everything, and I repeat, everything. I would go so far as to say, if the public would take a stand, and stop buying properties unless they got 100% of the property, maybe this could get the laws changed. I think that there are quite a few people out there, who, if they had been informed that they were not getting the mineral rights to their property, they would not have bought it in the first place. I think it is a shame that it is not a law to have to clearly state in the first sentence of a property sale whether or not they are getting all rights. This is something that should be addressed. Why is there not a state or nationwide Mineral rights registry, that ordinary people could access and know without a doubt what they are getting for their hard earned money. Why is there nothing in a deed or title that is current up to the minute of signing, that would let the buyer know what or where the mineral, surface, easements, leins, mortgages, and any thing else that might influence whether or not the buyer might want to spend their money on in buying the property? It looks like almost everything else in this country has to be spelled out for the ignorant people, (like ME), so how did this slip by, or was this a coincidence? It appears that money talks for the people who have it, and those who don't have it stay that way. It looks like the philosophy of the rich is to keep the poor people poor, Money talks, and poor people walk. I guess you get the drift.........
