has anyone heard where the state can claim 5/12 of the mineral, due to land foreclosed and bought by someone else, this happened in 1934.  can anything be done to clear the part the state will be claiming.

I am not familiar with the 5/12.

However, once upon a time, including in the '30s land adudicated to the state at tax sale included the minerals, and the state by law (as set forth in the State constitution ) retained these minerals should the land be sold or redeemed. I would have to see these instruments to be certain if this senario applied to you.
O, sorry, as to clearing the state claimed minerals, the State is forbiden by the constitution from divesting its mineral interest. So in short, no you can not get mienrals back from the state.


Now when land is adudicated and redeemed, the mineral go with the land. You are just out of luck as to the timing...
