Harrison County - Mineral Interest Severed from Surface Interest

I have a small piece of land that my father owned for many years.  A well was drilled and is now producing within a few hundred feet of my land.  I contacted the operator and they said the mineral rights were severed from the surface rights in 1959.  As a result, I have no rights for royalty income.  Any thoughts as to what I should do?  Should I pursue this further such as with an oil and gas attorney?  Or, should I drop it and not waste the money?

This isn't the first time we've had a mortgage crisis in America.  During the 1930s a lot of people in Harrison County sold their mineral interests to avoid foreclosure. 

 

You should be able to go to the courthouse  in Marshall to check this out for free.  I haven't been down there for over twenty years but to check up on this you should have the original deed, or the volume & page number of the original deed, or at least your last county tax assessment although this is the least helpful to resolve.

 

1959 seems like an odd year for this to occur, but perhaps you had a family illness or some other unusual event?

 

The TXRRcom is good about correcting any errors over a period of 3 years, but after 40 I don't think you should expect a correction.
