Been negotiating with Dawson since July '10 on a seismic permit contract for properties in the Walker and Matthews surveys in Panola. They offered $15/acre, which we refused, and finally they came back with $15 + prepaid damages of $10/acre for a total of $25/acre. We are currently receiving royalties from XTO, ArkLaTex, and Devon for unit wells in the Cotton Valley, which has been HBP since before my time as manager. The fact that Dawson wants to do seismic- I hope that means there's a vertical Pugh clause in those pre-existing leases signed by parents and grandparents (don't have a copy of those lease documents). We've not been approached by a landman for HA wells, and I haven't asked who Dawson is working for.
Has anyone else signed with Dawson recently? Anyone have good ideas as to what to include in the contract? I'm going to ask for shot lines to stay along property boundaries as much as possible, avoid soil compaction (for forestry reasons) as much as possible, cut no pine except boundary area saplings, avoid wetlands as much as possible, etc. What else should be in the contract?

Dawson hasn't made it to my properties in NW Panola county. They did go down some nearby properties two miles away.... which leads me to believe they've 'moved on'. I would have let them survey for free, as I have a 240 acre unleased tract... having seismics on the property would be invaluable.
As far as your parents or grandparents signing vertical pugh clauses, I'll have to say good luck. Most of the acreage in the county is HPB, and has been, for up to 60 years or more. Only in the last 4 or 5 years have I seen VPC language... before, who 'knew'?
$15/acre is what we accepted with a damage clause. I'm planning on watching them pretty close. Not sure what to expect - so far the guy that came out and put blue and white flags all over was nice but..
They have (had) been up for over a month - I call that damage - it ruins the view. Dont mind a temporary marker but over a month - come on! dont want ugly blue and white markers all over the property.
