you have asked a good question that is best answered by an oil & gas attorney.  I suggest that you post it again in the mineral rights group where you will get an educated answer.

Rodeo Mom--if you have title opinion prepared for your minerals in unit sent copy with demand letter certified mail they release a DO and pay you your royalties in rear up to date then montly per your lease. This will have no effect on curing title for the other minerals in the unit.

We have the same problem. We have interest in the Cornhuskers  DU 1H well that started selling gas in Feb. 2011

 and the Hurricanes DU 1H well that started selling in April 2011 , both are XTO wells. We can't seem to find out anything except they are working on it .

Same with the Bulls and Cardinals DU XTO wells--Cardinals has been selling since April,  Bulls tied up with RRC since May?

Well I spoke to XTO yesterday and they said we "Could POSSIBLY be in the August revenue run, but no promises"  so I ask about DO's and they said sometime they send royalty checks out before the DO's go out ???????? Not so sure about that......and if they do what are you setting yourself up for if you cash the check ???  Anyway if I was going to be in the August Revenue run wouldn't they know it by now.....it is August after all ?!?!?!?!?!?!?

They are giving you the "run-around". And they will send the checks before the DO. Maybe they meant next August (2012)...They are very slow in getting their DOs out. When you do finally get it, check every decimal and make sure it is accurate. Don't assume it is correct.

Etola, where are those woodpeckers that may prevent drilling?  I have a fairly new lease and a very well written deal (happy with it especially for the times).  l had an idea for years that would involve development for that land; man who really wanted to do it passed away suddenly during his fifties, but there are other things I could do with the land. I know that they are going through HBPing them now.  I really hope we make some changes for 2012, but there will have to be some serious business done and election needs to be well planned and settle on some good candidates.  The D & R poll that I saw today was almost a tie---scary!!

They have not let the woodpeckers slow them down as far as I can tell. LOL  All of the well sites are on private land and I have heard that they are doing all the required paperwork with the government to drill under their land.  Hopefully, the Danube will come in strong.  I think that's going to be the deal breaker on if they continue to drill Huxley and get all the leased land HBP.  They are finishing up the 3Dseismic along 139 around where your property is and maybe that will come in with favorable results.  If not, I don't know if they will drill in that area or not. Keep your fingers and toes crossed!

Thanks!  They did not do the 3D there though--Had sent paperwork but I suppose totally crossed it out.  Company  crossed it off---lease is fairly new so would be a long time to drill.  Maybe someone will get one drilled near and we can get an offset deal.  We have almost two years left on lease though; they did do the work there last time.  Sietel in  San Augustine told me it was crossed out as I called as summer is almost gone and no check;  I was filing and saw papers so I  called him. Maybe they will drill on the govt. when they do and I could keep my land intact to be better for another project; how about the old saying "Laugh all the way to the bank"?  We are surrounded by govt so I got the idea that they were skipping us.
