Newfield Drilling is drilling a well on our property. I do not own the mineral rights. They gave me an amount that they would pay me for the pad, and the road. They said that the road would be 30 feet wide. They have cut over 40 feet of trees for the length of the drive. They are placing about 5 or 6 culverts and leaving the downed trees on the low side of the road for erosion control. I think the amount that they offered is very low. They have taken up over 5 acres of land and derupted my Christmas tree planting.

Probably not much that can be done to improve your predicament but some additional details could help others who are in the same general situation but not as far along in the process as you. I am sorry to hear that you have not been better accomodated by the drilling company.

When did you first realize your property would be drilled? How long was it from that point that they actually started operations? What happened first? Next, etc?

How much did they offer? Was there any counter from you? What was their response? Any attorney involved?
Where is your property located?

I've seen questions like these in several places here but you have just provided a great opportunity to help a lot of people understand the process better from a non-mineral owner's perspective. Please share some details and information and you might even get back some good information that can help you.
I first realized they would drill on my property on 1-21-09, when they told me that they had staked the pad. They started moving equipment in the next day. They told us it would be a 500 by 500 pad and said their rate was $25,000 plus $1000 for the road. They didn't mention any damages for trees. They moved the pad 300' west and started clearing 1-23-09. They wanted to bring the road in from the neighbors property, but couldn't deal with them. They decided to put the road on our property. Now we have a 30 to 40 foot road running about 3500 feet through our land. They have cleared an area about 4.5 acres for the pad and 2.5 acres for the road to the pad. The offer decreased to $18500 for everything. I still have not signed any agreement and don't plan to until I get more money. They are going to dig a water well, but I don't need one. They said that they would put up a fence for about 2500 feet along my property, but again, I don't need one. They also didn't mention any annual rental.
Did you get timber damages? What about the water well, do you get the water well when they are done? Do you get an annual rental for the location?
