I just received a contract from TGG Pipline for a right of way in Section 24, township 14 North, Range 13 West of De Soto Parish. In it they talk about "all trees and debris on the right-of-way that GRANTEE clears will be disposed of, burned or buried." What I want to know is if there are trees, shouldn't the owners be given the option of selling and how do you get payment for future growth of trees? How do these companies compensate for that????

I am not an expert but you can have the timber harvested if you would like but you have to do it before they start clearing on the right of way. Their will be no future growth because they will keep the right of way clear and maintained from here on out. As to the compenstion, what you get now is all you get.
So, either get a good lawyer and negotiate well, or let the pipeline go on someone else's land. You don't have to sign the contract.

Deb, Rod and Henry are correct. Your timber will (should ) be cleared and sold by a licensed timber company. You have the right to pick this company. They normally do a survey of the trees affected by the servitude and quote a market price for them. This and what you and the pipeline company agree upon as far as per rod compensation is what you will be paid. I highly reccomend you and the family let an attorney assist you with this transaction. Servitudes can run 99 years. Once again, you only have one chance to get it right. Also regardless of what the landman tells you, take as much time as you and your attorney need work out an equitable aggreement.

hi deb, you can also require future crop value of your timber. if this is not an interstate pipeline and theres no eminent domain issues then you have better bargaing power
