Can husband witness wife's signature as to her separate property

I have another question about proper witnesses - when the land is situated in Louisiana. On several occasions I've had husbands witness their wife's signature when the wife was dealing with her separate property (and the husband wasn't a party, just a witness to his wife's signature). I've also had the reverse of this where the wife witnesses the husband's signature when its the husband's separate property (and the wife is not a party, just a witness). Seems like this is a fairly common practice with landmen.

My question, is this pracice in these circumstances (separate property) perfectly OK or would it be better to have someone other than the spouse witness the signing party's signature??? Any comments would be appreciated. Thank you.

or is it a moot point?
Uh Oh Parker,
I didn't see your correction comment until after I posted this one. I think the mute point was a Freudian slip on your part!!!
I'm glad I can laugh at myself.

I'm never at a loss for a good laugh.
Cathaus,

When I was at the dentist, the hygienist was having a little difficulty navigating. She said I didn't have a big mouth. I asked if I could have that in writing.
I would never be told that in a million years!
Unless you are laughing with a cracked rib.

OK — from the above posts, here’s a summary of the Louisiana witnessess rules:

1) It takes three witnesses for each party's signature if two of the witnesses are half-brothers.

2) It’s best if the witness dies soon after signing, and even better is he or she dies before signing.

3) A wife should not witness her husband’s signature when he's dealing with his separate property, unless there is a pending divorce, at which time she become a necessary witness.

4) Its fine to get witnesses from the Wal*Mart checkout line, but only if their names are Nosmo King and Noonea Round.

5) Always ask the witnesses and notary to use a signature stamp. However, Its preferable if the signature stamp is of their signature.

6) If there are any double letters in the witness name, ask the witness to omit one of those letters when they sign, so as to conserve ink and as their contribution to the fight against global warming.

Did I miss any?
