They more often than not drag it out until there are no further trial delays available to them but they avoid at all costs having case law made through a rendered verdict. Fear of bankruptcy just makes more plaintiffs prone to get to a settlement more quickly.
Permalink Reply by Steve P on January 19, 2016 at 12:39 I think the mere fact that CHK is settling lawsuits is a really good sign for those of us having to deal with the company about our own leases. If they were on the brink of bankruptcy, they wouldn't be settling suits. When you settle the suit, you have to presumably write a check.
At this point, that's a good sign.
Permalink Reply by Skip Peel - Mineral Consultant on January 19, 2016 at 12:50 CHK has been settling lawsuits for years, it's not a new development although the thought process for plaintiffs may be influenced by the company's current financial situation. I've been involved, on the periphery of several suits that CHK settled. The major problem is that those suits got settled instead of proceeding to a verdict and therefore creating case law that could have been used by other similarly situated plaintiffs. Settlements benefit a small number of plaintiffs, and CHK.

Permalink Reply by Skip Peel - Mineral Consultant on January 20, 2016 at 3:20 Doesn't change the fact, on CHK's part, that they settle every case they have a chance of losing and no case law ever gets made. If a ruling in an improper deductions case ever went against them it would open the flood gates to litigation on the same cause of action. My point is, that is and has been their strategy for years and hasn't changed because their financial position has changed.
Permalink Reply by Mike Bradstreet on January 23, 2016 at 4:16 I'm in the McDonald lawsuit in Woodford gas area, the suit only ask for a percentage of back royalty, and does not keep CHK from fraudulent accounting as usual, guess you need to sue every few years to catch up, I believe the SEC should be involved, and people at CHK put in jail, worse than that bankruptcy is eminent!
