What is the determination if adjoining neighbors should get royalties off of a producing well even though their land is not leased?

Elaine, I noticed on your profile that you are in Nacogdoches.  I have deleted my answer to your question as it was based on my assumption that your minerals were in LA.  I'll let some of the knowledgeable E. TX. members answer your question.  TX. mineral law has substantial differences from that of LA.

Is their land included in the unit boundaries?  They can adjoin you without being in the unit but the only way to know that is to get the unit plat from the county.  There will be a plat in the Unit Designation (County Clerk's records) or the Appraisal District would have that information.  The plats at RRC may not be as up to date as the county records.

If tract is not the drill-tract, UMO does not get paid! If UMO is under drill-tract, UMO is "partner" but will only be paid a net check, AFTER HIS part of all well expenses have been paid back----probably down the way a few or more years.
