you talking about the Harvey #1 H premit TD 18000' includes 4300' H leg, so vertical depht ~ 12-13000' in the H. Ashabranner survey 8.5 miles NE of Center. This will be the well to watch for Shelby county. This is mostlikely 1st shale well H. It is not 1st well CHK has drilled in Shelby.
according to rrc since 1990 this is the only well permitted by or in chespeak name in shelby county
HS hard to beleive but you are right this is 1st well period that CHK has premitted to drill in Shelby County. Will not be last I bet. This area ( about 6 mile radius of this well especially J. Engish and J. White Surveys)I hear is the best core shale geologist speaking in Shelby County. The Shale extends all the way to the SSE part of Shelby into NNE Nacgodoches County---Watch new when release about DVN McSwain #7H well it is a monster. This area of the Harvey will be as good or mostlikely better
WENT BY THE MCSWAIN 7 A FEW DAYS AGO , THEY STILL HAVE COLE TUBING UNIT ON SITE
BUT NOT ALOT OF PRESSURE TRUCKS AND OTHER GUESS THEY ARE GETTING CLOSE TO COMPLETION. HAVE HUGH TREE ON WELL HEAD IF THATS ANY INDICATION. DONT REALLY KNOW WERE THAY WENT ON POWDRILL DRILL JUST WEST OF THERE BUT ALSO HAVE COLE TUBING UNIT ON SITE. GOOD TO SEE THEM AT LEAST MOVE THE RIG OFF IT AFTER 90 DAYS.
HAD TO BE A VERY COSTLY DRILL.
bad news about McSwain 7H --they screw the well--pipe problem--may only make about 2mmcf/day don't know if can be resolved
HS, I don't know where the McSwain is in relation to the Powdrill. How far apart are they? The Powdrill#2 went to about 15,000 feet or more, and maybe more when they kicked out...(I don't know) I'm not sure where they were when they stopped drilling on Christmas Day. The Well Head is not all that big, but they are not finished yet. Can that change? Can they add more well head equipment before they are finished? Why did they come in with a big crew to frac, and then leave for a week, then come back in on Monday. I'm hoping all the work is, All Good. Devon, did stake a Powdrill#3, last week.
adubu, Is there a map I could see on-line that would show this extended area of the SSE part of Shelby into the NNE Nacogdoches county?
eat beef--go to the texas rrc web site and click on the GIS Map viewer and you can zoom in any where in state and see all wells drilled since 1993 with all info about them

I own mineral rights in the H. Ashabranner survey. Tried asking a question on the mineral rights/lease error discussion, but didn't hear anything back.
What happens if you have non-participating mineral rights? I know I am not entitled to any of the bonus payment, but I am entitled to royalty payments at whatever the lease amount stipulates. How do I make sure that the company that leased the mineral rights knows about us? Due to a convoluted legal agreement many years ago (1930's) by my ancestors, I own mineral rights in area "A." I also own 1/4 non-participating mineral rights in area "B" (adjoining tract). The person with mineral rights in area "B" has 1/4 non-participating rights in area "A." Never knew this until I was approached by someone wanting to purchase my non-participating mineral rights. Nothing is stipulated in my lease of area "A" about the person(s) with non-participating rights.

I don't live in TX and I don't think anything was filed in TX when I inherited the property in the 1990's. Do I need to do anything? Certainly becoming a more pressing issue with this latest development.
Not sure I can shed much light on this for you. Are your minerals currently leased? Do you know who owns the surface and the other mineral interest in your tract? How, specifically, were the minerals described in the deeds? What does area "A" and area "B" refer to? Two seperate tracts of land? Just trying to get some details out here so maybe you can get some insight.

Based on your explanation, you could be in one of two situations, as follows:

1. The less likely version is that you do indeed own non-participating mineral rights in area "B", which means that someone else holds the "executive rights" on your minerals - someone else actually negotiates and signs the lease, but you would enjoy bonus and royalty based on your interest.

2. The more likely scenario, and more common, is that you you don't own actual minerals at all in area "B", but rather a non-participating royalty interest, or NPRI as it is more commonly called. This just means that when one of your predecessors in title sold his interest in area "B", he reserved unto himself 1/4 of all royalty, usually described as "saved or produced". If a mineral interest was reserved, it would more likely be described as all minerals "in or under" said tract.

Also keep in mind that even if your old deed describes the reservation as a mineral reservation, but the actual wording is "all minerals saved and produced", you are actually looking at a royalty reservation and not a mineral reservation. There is a difference between the two (minerals and royalty), as they can be severed from one another just as surface estate and mineral estate can be severed.

As for letting the O&G company know of your interest, there probably is no need to actually let them know anything directly. However, based on what you said about not being in Texas and nothing being filed, a nicely worded Affidavit of Heirship filed of record with the Shelby County Clerk should lead them straight to you.
