UNCERTAIN, TEXAS MAN GUILTY OF INVESTOR FRAUD

MARSHALL, Texas – U.S. Attorney John M. Bales announced today that a 47-year-old Uncertain, Texas man has pleaded guilty for his role in a multi-million dollar oil and gas scheme in the Eastern District of Texas.

RICHARD W. MCFARLAND, Jr., pleaded guilty to mail fraud on Mar. 26, 2010, before U.S. Magistrate Judge Chad Everingham.

According to information presented in court, McFarland was founder and President of Delta Interest, Inc., a company based in Marshall, Texas, which purportedly obtained working interests in oil and gas wells located within Texas and then offered portions of those interests for sale to the public.  From 2003 to 2009, McFarland devised a scheme in which he falsely represented to investors that they were purchasing interests held by Delta Interest in wells located on various leases, when in fact, no such wells or leases existed.  To further facilitate the scheme, McFarland sent investors fraudulent monthly production statements which contained fictional production and sales figures as well as supposed investor revenue amounts related to the non-existent wells.  McFarland used a significant portion of the investor funds to make purported revenue payments on a regular basis to earlier-in-time investors.  This funneling of proceeds received from new investors to previous investors induced new investors to participate and, in some instances, existing investors to contribute additional sums.  He expended the remainder of investor monies for his own business and personal use.  As a result of this scheme, McFarland fraudulently obtained in excess of $30 million from more than 350 investors who were residing in approximately 25 different states.

At sentencing, McFarland faces up to 20 years in federal prison.  A sentencing date has not been set.

This law enforcement action is part of President Barack Obama’s Financial Fraud Enforcement Task Force.

President Obama established the interagency Financial Fraud Enforcement Task Force to wage an aggressive, coordinated and proactive effort to investigate and prosecute financial crimes.  The task force includes representatives from a broad range of federal agencies, regulatory authorities, inspectors general, and state and local law enforcement who, working together, bring to bear a powerful array of criminal and civil enforcement resources. The task force is working to improve efforts across the federal executive branch, and with state and local partners, to investigate and prosecute significant financial crimes, ensure just and effective punishment for those who perpetrate financial crimes, combat discrimination in the lending and financial markets, and recover proceeds for victims of financial crimes.

A local oil and gas investor was sentenced to 97 months in federal prison Friday for his role in a multi-million dollar oil and gas Ponzi scheme.

U.S. District Judge T. John Ward also ordered the investor, 47-year-old Richard W. McFarland Jr. of Marshall, to pay $8.8 million in restitution.

According to a press release, McFarland pleaded guilty on March 26 to mail fraud.

"According to information presented in court, McFarland was founder and President of Delta Interest, Inc., a company based in Marshall, which purportedly obtained working interests in oil and gas wells located within Texas and then offered portions of those interests for sale to the public," a press release indicates.

The press release notes from 2003 to 2009, McFarland devised a scheme in which he falsely represented to investors that they were purchasing interests held by Delta Interest in wells located on various leases, when in fact, no such wells or leases existed.

"To further facilitate the scheme, McFarland sent investors fraudulent monthly production statements, which contained fictional production and sales figures as well as supposed investor revenue amounts related to the non-existent wells," the press release states. "McFarland used a significant portion of the investor funds to make purported revenue payments on a regular basis to earlier-in-time investors. This funneling of proceeds received from new investors to previous investors induced new investors to participate and, in some instances, existing investors to contribute additional sums."

The press release goes on to say that McFarland expended the remainder of investor funds for his own business and personal use. As a result of this scheme, he fraudulently obtained in excess of $30 million from more than 350 investors who were residing in approximately 25 different states.

This case was investigated by the Texas State Securities Board and the FBI and prosecuted by Assistant U.S. Attorney Frank Coan.

Can any of his "investors" (victims?) get their money back?
Sorry for the delay, CypressKnees!  The court ordered restitution, but that would be a miracle. He's in the federal pen for almost 8 years. He SAYS he has nothing.

The company is named "Delta Interests"?

Confusing, as aren't several companies called Delta this or that?

Oil Girl, your picture by your name-where is that? My ignorance, but is it the Dome of the Rock?

yes it is
Aubrey is running the biggest Ponzi scheme since Bernie Madhoff..........................................according to Jack Blake
not as big as social security though.
WOW... i sure hope not.  A billion angry Chinese can really ruin your day!

Jack, please explain in more detail about your statement about Chesapeake.  This is of

much interest since there has been interest to lease some of my land, by Chesapeake, but

seems to be some delay though.  They backed out of a tentative agreement to lease for a

specified bonus in two different locations, and now not leasing even in what I would call

a hot area in Natchitoches Parish.  Chesapeake some years past did a 3D Seismic of our

land in Natchitoches Parish.  Have been reading this site and noticed some of the comments

about Chesapeakes' activity with various landowners (Lessors).  Seems that a Lessor has to

do a lot of homework and some very detailed Addendums (Clauses) to protect its interest

in a lease.  Any information you can share would be appreciated.

What does this mean?
Richard McFarland had Delta Interest Inc., Delta Interest LLC, Caddo Resources, Boomtown LLC, Caddo Operating and several other companies. He would bankrupt one company while opening another. Major CROOK!!!
I have no idea what the photo is. Just thought it was cool.  :)

I find this kind of activity way too common to suit me.

Where is the industry  in calling these people out?

All I can hear is silence.

But now I know who to call - the FBI.
