we need help as we signed early but hk didn't pay until two weeks after due date . we sent the check back as $ 600/ac was not fair after their default . unfortunately for us they recorded the lease and will not release it . it seems we were treated differently from others . now it seems our only recourse is to sue . much money and time . they have refused to even talk to us . our case will depend on timely payment so any information would be greatly appreciated .

we had the bank officer , the bank lawyer and our lawyer count the banking days . on the due date the bank called hk's bank and they said the checks in the mail . the bankers and lawyers met two days later and perused the bank mail and no check . our banker called the bank and again they said the checks in the mail . of course all of the correspondence sent and rec'd dates by registered mail and all phone calls logged . about a week later we rec'd a check by us mail not bank wire or overnight express . we returned the check citing failure to hold up their end of the bargain . of course a title search revealed they recorded the lease the day after we signed .
oh no we got lawyers in bossier and houston . one litigator and one negotiator but going to court is probably three years . i mainly want to know if we were treated differently than others . i've never welched on deal if if it nearly broke me . we were had no problems honoring the deal even though we left most of the money on table . once the deal terms weren't met after every effort to communicate they were late per the committee i mentioned before all bets off . the last straw was the mailing a week late . i think the unit permit hearing we be interesting as we have land in four sections.
KB, other factors come into play also, depository banks sitting on drafts for 2 weeks or longer is the main thing that I have found that delays payment. We hold drafts until all involved have signed like in the case of naked owners.
Our family had a lease expire 2 weeks ago tomorrow (12/1/08) that was signed by Devon. They worked personally with the local landman in Center, Texas. Has anyone been paid by Devon recently?
