Do I have to have it filed all over again, or can there just be an amendment done?

And about how much would that cost?

Can this matter be handled at the court house only?

Ken, answering a few questions would help you get some answers:

1. What state was the succession/probate administered?

2. What state was the succession filed?

3. What is the mistake you're looking to fix?

4. What is the exact document that has the mistake (affidavit of death and heirship, judgment of possession, will, etc.)?

1. Louisiana

2. Louisiana

3. mistake on lot numbers

4. small succession

Ken,

I sent you GHS message about this, check your inbox.

You can amend the small succession to identify the errors in the original, and the relevant corrections. This correction must be notarized and then filed in the conveyance records of the parish where the property is located. It would be best if you get the original affiants (i.e. people who signed it the first time) to appear before the same notary for the correction.

If any third party is disputing your ownership or the small succession, you should get a certified copy of the correction from the clerk of court after you file it. Forward that to third parties by certified mail, return receipt requested.

Do a lawyer have to do it or can it be done by a family member?

If you send me a PM I'll try to point you in the right direction.
