I've started getting checks that I wasn't expecting. They were sent to unclaimed properties and I was contacted by them. I've contacted the oil company and they are still sending checks. One question is, on the checks, its says My Name, Separate Property, what does separate property mean? This is in Louisiana and company is Wildhorse. I have been trying to contact them to find out if money was coming from old land I had or possibly an heir, I just don't know. I wasn't expecting anything from an heir but its impossible to get in touch and communicate with them.

If you inherit property from family then it is your separate property or if you buy property before you marry then it is your separate property.
Permalink Reply by Axe on February 4, 2015 at 14:16 How would the oil company, whom I've never spoken with, know if I'm married or not. I've been married since 09 and just started receiving these checks. Wife and I bought property together but live in city now. They were searching for me at old address but I never owned mineral rights and sold that property in 09. I have not inherited any property
Permalink Reply by Two Dogs, Pirate on February 4, 2015 at 14:21 The property is probably different that what you and your wife bought. If you have a pre nep agreement with your wife and bought the property then the property could be your separate property.
Permalink Reply by Two Dogs, Pirate on February 4, 2015 at 14:33 You may not know you inherited property. Something doesn't smell right with this deal.Operators generally try to lease everyone in a unit and most don't just start sending out checks. Why are you having problems contacting Wildhorse?
Permalink Reply by Axe on February 4, 2015 at 14:39 I've emailed them and called, leaving voicemails. Lady I talked to today said everything was fine but I can't get an answer on where actually money is coming from. Emails and phone calls go mostly unanswered. I have a list of wells that I have interest in and can't figure out where they are either. I have a relative that died a few years ago that was huge in oil business but he was in his 90s and I was never told of getting anything from him. Besides, he isn't from around Lincoln parish, although I visited with him all the time.
Permalink Reply by Two Dogs, Pirate on February 4, 2015 at 14:43 He may have left some of the property to you. Sometimes it is hard to find people and you may fall into that category.

Permalink Reply by Nixon Dow on February 4, 2015 at 14:57 Might be working interest or ORRI from deal long ago. If he was big in the industry it would not surprise me. As I recall the Wildhorse stuff in Lincoln sits is located in a field that has old production. In areas like this it is not uncommon to have leases dated back 1940-1960. If that is the case your uncle might have been involved one way or another and later subleased their rights and kept an override.

Permalink Reply by Two Dogs, Pirate on February 4, 2015 at 14:48 All he would have had to own was mineral interests.
Permalink Reply by Axe on February 4, 2015 at 14:55 Would oil company be able to find all this out for me or is this something I would need to get an attorney for? I was very close to him and when he died about 3 years ago I remember people I've never heard of flocking for his stuff so I just stayed out. He had no kids and only married once, wife died back in the early 1950s. All his siblings are deceased and my dad and I have no clue how to find out what's going on.
Permalink Reply by Two Dogs, Pirate on February 4, 2015 at 15:05 You could look for his probate proceedings in the Parish/County where he died. If he died in Louisiana then I may have online access to the records. I don't have access to Lincoln Parish at this time because I haven't worked there in several years.

In researching the decades-old Tuscaloosa Trend and the immense wealth it has generated for many, I find it deeply troubling that this resource-rich formation runs directly beneath one of the poorest communities in North Baton Rouge—near…

AboutAs exciting as this is, we know that we have a responsibility to do this thing correctly. After all, we want the farm to remain a place where the family can gather for another 80 years and beyond. This site was born out of these desires. Before we started this site, googling "shale' brought up little information. Certainly nothing that was useful as we negotiated a lease. Read More |
