any one done ROW for drill section laid pipeline? Energy Transfer is putting in a 26" pipeline and because of environment regulation it will require them to drill under a flood plain by a river. The pipe will be 4' below surface and be pulled back thru the drill bore hole so no temp construction surface easement required just still the need a 50' permanent easement on surface. What the market per rod payment for damage on the 50' easement?

I can tell you that ETP ended up paying right at $760 a rod for the 42" line with 50' perm and 60' temp. I would add that their easement overlapped an existing easement which kind of hamstrung us in negotiations. This was in RR parish. $500 a rod for smaller lines is pretty normal in La.

You absolutely need to confer with an experienced ROW attorney. One name for you to consider is Randall Davidson in Shreveport. Very experienced and very competent. A good lawyer can protect you today, but more importantly, for years out. Once you grant a ROW, you're married to it, for better or worse. I know from experience you must lock in your protections now, or live with the consequences down the road. Good luck....Regarding what's being paid, down in Sabine Parish they're paying $450 a rod, plus damages, for 50' ROW, with 25' temp work area, up to 24" line. They will try to get you to accept up to 4 lines, but will agree to a single line, with future lines to be negotiated.
